AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, FURTHER PROVIDING FOR EXEMPTIONS OF ENTITIES AND <-- 3 VEHICLES FROM FEES; FURTHER PROVIDING FOR THE MAXIMUM SPEED 4 LIMIT ON THE PENNSYLVANIA TURNPIKE; defining "trail bikes"; 5 and permitting limited highway crossings and use. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 SECTION 1. SECTION 1901(B) OF TITLE 75 OF THE PENNSYLVANIA <-- 9 CONSOLIDATED STATUTES IS AMENDED BY ADDING A PARAGRAPH TO READ: 10 § 1901. EXEMPTION OF ENTITIES AND VEHICLES FROM FEES. 11 * * * 12 (B) TITLE AND REGISTRATION FEES.--NO FEE SHALL BE CHARGED 13 FOR TITLING OR REGISTRATION OF ANY OF THE FOLLOWING: 14 * * * 15 (5) VEHICLES ON LOAN OR TRANSFERRED TO A NONPROFIT 16 CORPORATION BY THE UNITED STATES DEPARTMENT OF DEFENSE OR THE 17 UNITED STATES GENERAL SERVICES ADMINISTRATION AND USED 18 EXCLUSIVELY FOR LEASING TO POLITICAL SUBDIVISIONS AND STATE
1 AGENCIES. 2 * * * 3 SECTION 2. TITLE 75 IS AMENDED BY ADDING A SECTION TO READ: 4 § 3369. PENNSYLVANIA TURNPIKE. 5 THE MAXIMUM SPEED LIMIT ON THE PENNSYLVANIA TURNPIKE AND ALL 6 EXTENSIONS THEREOF, OR ANY PORTION OF THE PENNSYLVANIA TURNPIKE 7 AND ITS EXTENSIONS, MAY BE INCREASED TO 65 MILES PER HOUR AT THE 8 DISCRETION OF THE PENNSYLVANIA TURNPIKE COMMISSION. 9 SECTION 3. SECTION 6110(A) OF TITLE 75 IS AMENDED TO READ: 10 § 6110. REGULATION OF TRAFFIC ON PENNSYLVANIA TURNPIKE. 11 (A) GENERAL RULE.--THE PROVISIONS OF THIS TITLE APPLY UPON 12 ANY TURNPIKE OR HIGHWAY UNDER THE SUPERVISION AND CONTROL OF THE 13 PENNSYLVANIA TURNPIKE COMMISSION UNLESS SPECIFICALLY MODIFIED BY 14 RULES AND REGULATIONS PROMULGATED BY THE COMMISSION WHICH SHALL 15 BECOME EFFECTIVE ONLY UPON PUBLICATION IN ACCORDANCE WITH LAW. A 16 COPY OF THE RULES AND REGULATIONS, SO LONG AS THEY ARE 17 EFFECTIVE, SHALL BE POSTED AT ALL ENTRANCES TO THE TURNPIKE OR 18 HIGHWAY FOR THE INSPECTION OF PERSONS USING THE TURNPIKE OR 19 HIGHWAY. THIS SECTION DOES NOT AUTHORIZE THE ESTABLISHMENT OF A 20 MAXIMUM SPEED LIMIT GREATER THAN 55 MILES PER HOUR ON ANY 21 PORTION OF THE PENNSYLVANIA TURNPIKE UNLESS A SPEED LIMIT OF 65 22 MILES PER HOUR THEREON HAS BEEN AUTHORIZED BY THE PENNSYLVANIA 23 TURNPIKE COMMISSION. 24 * * * 25 Section 1 4. The definition of "all-terrain vehicle" in <-- 26 section SECTION 7702 of Title 75 of the Pennsylvania <-- 27 Consolidated Statutes is amended BY ADDING A DEFINITION to read: <-- 28 § 7702. Definitions. 29 The following words and phrases when used in this chapter 30 shall have, unless the context clearly indicates otherwise, the 19890H1849B3707 - 2 -
1 meanings given to them in this section: 2 * * * 3 "Trail bike." A motorized off-highway vehicle, 60 inches or 4 less in width, having a dry weight of 800 pounds or less, 5 traveling on two tires and having a seat designed to be 6 straddled by the operator is designated as a Class III all- <-- 7 terrain vehicle. 8 Section 2 5. Section 7721(c) and 7723 of Title 75 are <-- 9 amended to read: 10 § 7721. Operation on streets and highways. 11 * * * 12 (c) Crossing street or highway.--A snowmobile or trail bike 13 or an ATV may make a direct crossing of a street or highway upon 14 compliance with the following requirements: 15 (1) The crossing is made at an angle of approximately 90 16 degrees to the direction of the highway and at a place where 17 no obstruction prevents a quick and safe crossing. 18 (2) The snowmobile, trail bike or ATV is brought to a 19 complete stop before crossing the shoulder or main-traveled 20 way of the highway. 21 (3) The driver yields the right-of-way to all oncoming 22 traffic which constitutes an immediate hazard. 23 (4) In crossing a divided highway, the crossing is made 24 only at an intersection of such highway with another public 25 street or highway. 26 § 7723. Special snowmobile, trail bike and ATV events. 27 (a) General rule.--Snowmobiles, trail bikes and ATV's may be 28 operated on highways and streets for special snowmobile, trail 29 bike and ATV events of limited duration which are conducted 30 according to a prearranged schedule under permit from the 19890H1849B3707 - 3 -
1 governmental agency having jurisdiction. 2 (b) Authority of local authorities.--A local authority may 3 block off highways and streets within its jurisdiction for the 4 purpose of allowing snowmobile, trail bike and ATV races, 5 rallies or derbies. No State trunk highway or connecting street, 6 or part thereof, shall be blocked off by any local authority for 7 any snowmobile, trail bike or ATV race, rally or derby. 8 (c) Notification and duty of police.--A local authority 9 shall notify the local police department and the county 10 sheriff's office at least one week in advance of the time and 11 place of any snowmobile, trail bike or ATV race, rally or derby 12 which may result in any highway or street, or part thereof, 13 being blocked off. Upon such notice, the local police department 14 shall take such measures as it deems appropriate to protect 15 persons and property and to regulate traffic in the designated 16 area and its vicinity on the day of such race, rally or derby. 17 Section 3 6.
