                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," further providing for
     4     State plan for regulating and licensing personal care homes,
     5     for Intra-Governmental Council on Long-Term Care and for
     6     rules and regulations for personal care homes and assisted
     7     living residences.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 211(l) of the act of June 13, 1967
    11  (P.L.31, No.21), known as the Public Welfare Code, amended July
    12  25, 2007 (P.L.402, No.56), is amended to read:
    13     Section 211.  State Plan for Regulating and Licensing
    14  Personal Care Homes and Assisted Living Residences.--* * *
    15     (l)  The department shall annually conduct at least one
    16  onsite unannounced inspection of each personal care home and
    17  each assisted living residence. Within forty-eight hours of
    18  receipt of a complaint from any person alleging an immediate


     1  serious risk to the health and safety of a resident of a
     2  personal care home or an assisted living residence, the
     3  department shall conduct an onsite unannounced inspection of the
     4  personal care home or assisted living residence. Additional
     5  announced or unannounced inspections may be conducted by the
     6  department as the department deems necessary. When developing
     7  regulations under this act, the department may provide for an
     8  abbreviated annual licensure visit when a residence has
     9  established a history of exemplary compliance.

    11     Section 2.  This act shall take effect October 23, 2007, or
    12  immediately, whichever is later.
