AN ACT 1 Amending Title 37 (Historical and Museums) of the Pennsylvania 2 Consolidated Statutes, establishing the Pennsylvania Military 3 Monument Board within the Pennsylvania Historical and Museum 4 Commission; and making an appropriation. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 103 of Title 37 of the Pennsylvania 8 Consolidated Statutes is amended by adding a definition to read: 9 § 103. Definitions. 10 Subject to additional definitions contained in subsequent 11 provisions of this title which are applicable to specific 12 provisions of this title, the following words and phrases when 13 used in this title shall have the meanings given to them in this 14 section unless the context clearly indicates otherwise:
1 * * * 2 "Board." The Pennsylvania Military Monument Board within the 3 Pennsylvania Historical and Museum Commission of the 4 Commonwealth. 5 * * * 6 Section 2. Title 37 is amended by adding a section to read: 7 § 308. Pennsylvania Military Monument Board. 8 (a) Establishment.--The Pennsylvania Military Monument Board 9 is established within the commission. 10 (b) Membership.--The board shall consist of the executive 11 director of the commission; one member of the National Park 12 Service at Gettysburg, who is a maintenance exhibit specialist; 13 the Gettysburg Borough Preservation Officer; one member of the 14 Gettysburg Licensed Battlefield Guides Association; one member 15 who is a representative of the Department of Community and 16 Economic Development, Office of Travel and Tourism; two members 17 elected to the Senate who serve on the Committee on Community 18 and Economic Development of the Senate, one from the majority 19 party and one from the minority party appointed by the President 20 pro tempore of the Senate; two members elected to the Committee 21 on Tourism and Recreational Development of the House of 22 Representatives, one from the majority party and one from the 23 minority party appointed by the Speaker of the House of 24 Representatives; and one nonvoting member selected by the board 25 for a two-year term. 26 (c) Chairman.--The executive director of the commission 27 shall serve as chairman of the board. The chairman may appoint 28 committees of board members to carry out the work of the board. 29 The chairman may remove any committee member for any reason if 30 it affects the member's ability or willingness to perform his 19970H1863B2331 - 2 -
1 duties. 2 (d) Quorum.--Five members shall constitute a quorum. 3 (e) Vacancies.--In the event of a vacancy on the board, the 4 chairman shall appoint a successor within 30 days of the 5 vacancy. In the event of a vacancy on a committee, the chairman 6 shall appoint a successor for the duration of the committee. All 7 committee members must be board members. 8 (f) Procedures.--The board may adopt procedures for the 9 orderly conduct of board and committee meetings. 10 (g) Compensation; expenses.--No member of the board shall 11 receive any compensation for his services but may be reimbursed 12 for any actual and necessary expenses related to his duties 13 under this section. 14 (h) Meetings.--The board shall meet a minimum of four times 15 each calendar year. Other meetings may be called by the chairman 16 of the board or the committee chairman as the need arises. 17 (i) Powers and duties of board.--The board shall: 18 (1) Undertake an inventory of Pennsylvania military 19 monuments at Gettysburg National Military Park, including the 20 name, date of construction, location and means of access and 21 the original sponsorship of each monument. 22 (2) Complete description of each monument, including 23 construction materials, condition, theme and inscription. 24 (3) Assume responsibility for maintenance. 25 (4) Make a determination as to the cost of restoration 26 of each monument and the ground area adjacent to the monument 27 which is in need of repairs. 28 (5) Procure sufficient funds for the restoration of the 29 monuments and the ground area adjacent to the monuments. 30 (6) Determine which of the monuments is in need of 19970H1863B2331 - 3 -
1 immediate care and compile a list of monuments needing repair 2 or restoration in order of need by conducting an onsite 3 review by the board or a committee. 4 (7) Work closely with the National Park Service at 5 Gettysburg National Military Park in all aspects regarding 6 the conducting of board duties. 7 (8) Prepare education and tourism materials for public 8 distribution and work in conjunction with the Department of 9 Transportation, the Department of Community and Economic 10 Development and the Office of Travel and Tourism to achieve 11 integration of the information on Pennsylvania's military 12 monuments at Gettysburg National Military Park in their 13 official publications. 14 (9) Conduct fundraising by making the program visible, 15 by working with the media in the preparation of brochures and 16 by engaging in public relations with clubs and organizations. 17 (10) Create a separate account for all funds raised 18 pursuant to this section. 19 (11) Establish an Adopt a Monument Program whereby any 20 veteran, fraternal, patriotic, civic, service or youth 21 organization may apply to adopt a monument. 22 (12) Annually prepare a report to the General Assembly 23 by presentation to the Secretary of the Senate and the Chief 24 Clerk of the House of Representatives. 25 Section 3. The sum of $250,000, or as much thereof as may be 26 necessary, is hereby appropriated to the Pennsylvania Historical 27 and Museum Commission to carry out the provisions of this act. 28 Section 4.
