| AN ACT |
| |
1 | Limiting the electronic swiping of a driver's license or |
2 | identification card; and prescribing penalties. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Short title. |
6 | This act shall be known and may be cited as the |
7 | Identification Card Electronic Swiping Act. |
8 | Section 2. Definitions. |
9 | The following words and phrases when used in this act shall |
10 | have the meanings given to them in this section unless the |
11 | context clearly indicates otherwise: |
12 | "Business." A proprietorship, partnership, corporation or |
13 | any other form of commercial enterprise. |
14 | "Department." The Department of Transportation of the |
15 | Commonwealth. |

1 | "Legal requirement." A duty in statutory law or an action |
2 | ordered by a court of law. |
3 | "Swipe." To pass a plastic card with a magnetic strip |
4 | containing encoded data through an electronic device to obtain |
5 | any of the encoded data or information contained on the plastic |
6 | card. |
7 | Section 3. Electronic swiping of cards. |
8 | (a) Permitted uses.-- |
9 | (1) A business may swipe a driver's license or |
10 | identification card issued by the department in an electronic |
11 | device for only the following purposes: |
12 | (i) To verify the authenticity of the driver's |
13 | license or identification card or the age of the person |
14 | to whom the driver's license or identification card was |
15 | issued. |
16 | (ii) To comply with a legal requirement to record, |
17 | retain or transmit the information contained on the |
18 | driver's license or identification card. |
19 | (iii) To transmit information to a check service |
20 | company for the purpose of approving negotiable |
21 | instruments, electronic funds transfers or similar |
22 | methods of payments, provided that only the name and |
23 | identification number from the driver's license or |
24 | identification card may be used or retained by the check |
25 | service company. |
26 | (iv) To collect or disclose personal information |
27 | that is required for reporting, investigating or |
28 | preventing fraud, abuse or material misrepresentation. |
29 | (2) A business may not retain or use any of the |
30 | information obtained by that electronic means for any purpose |

1 | other than as provided under this section. |
2 | (b) Violation.--A violation of this section constitutes a |
3 | misdemeanor punishable by imprisonment in a county jail for not |
4 | more than one year or by a fine of not more than $10,000, or |
5 | both. |
6 | Section 4. Effective date. |
7 | This act shall take effect in 60 days. |
