                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     legal representation.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 2501(b) of Title 42 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 2501.  Appearance in person or by counsel.
     9     * * *
    10     (b)  Criminal matters.--[In]
    11         (1)  Subject to paragraph (2), in all criminal
    12     prosecutions the accused has a right to be heard by himself
    13     and his counsel.
    14         (2)  The accused has a right to be heard by himself or a
    15     parent or guardian and his counsel if all of the following
    16     apply:
    17             (i)  The accused is under 18 years of age.


     1             (ii)  The accused is charged with an offense which:
     2                 (A)  is graded below a misdemeanor of the third
     3             degree; and
     4                 (B)  is not subject to section 6303(a)(5)
     5             (relating to scope of chapter).
     6     Section 2.  The amendment of 42 Pa.C.S. § 2501(b) shall apply
     7  to actions commenced on or after the effective date of this act.
     8     Section 3.  This act shall take effect in 60 days.
