AN ACT
1 Amending the act of July 6, 1989 (P.L.169, No.32), entitled "An
2 act providing for the regulation of storage tanks and tank
3 facilities; imposing additional powers and duties on the
4 Department of Environmental Resources and the Environmental
5 Quality Board; and making an appropriation," further
6 providing for aboveground storage tanks.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 301(a) of the act of July 6, 1989
10 (P.L.169, No.32), known as the Storage Tank and Spill Prevention
11 Act, is amended by adding a paragraph to read:
12 Section 301. Aboveground storage tank requirements.
13 (a) Minimum program requirements.--The department shall, by
14 regulation, adopt and implement an aboveground storage tank
15 program that, at a minimum, requires all of the following:

17 (12) Standards for the approval of arrangements entered
18 into between aboveground storage tank owners and businesses
19 for the shared use of an aboveground storage tank as a
1 nonretail distribution point.

3 Section 2. This act shall take effect in 60 days.
