AN ACT 1 Prohibiting the Commonwealth and its political subdivisions from 2 collecting and using Social Security numbers under certain 3 circumstances; and providing for enforcement by the Attorney 4 General. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Use of Social Security numbers. 8 (a) General rule.--It shall be unlawful for an officer, 9 employee or agent of a State agency, department, board or 10 commission or political subdivision of the Commonwealth, acting 11 within the scope of that person's official duties, employment or 12 agency, to collect or use a Social Security number for any 13 purpose other than as authorized by the Privacy Act of 1974 14 (Public Law 93-579, 5 U.S.C. § 552a). 15 (b) Duty to inform the basis of disclosure.--Any such 16 officer, employee or agent who requests an individual to
1 disclose that individual's Social Security account number shall 2 inform that individual whether the disclosure is mandatory or 3 voluntary, by what statutory or other legal authority the number 4 is required and what uses will be made of the number. 5 Section 2. Enforcement. 6 The Office of Attorney General shall enforce the provisions 7 of this act by bringing an action for injunctive relief in a 8 court of competent jurisdiction. 9 Section 3.
