AN ACT 1 Authorizing and directing the Department of General Services, 2 with the approval of the Governor, to convey tracts of land 3 and buildings, consisting of a portion of the former 4 Laurelton Center, located in Hartley Township, Union County, 5 Pennsylvania. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. The Department of General Services, with the 9 approval of the Governor, is hereby authorized and directed, on 10 behalf of the Commonwealth of Pennsylvania, to grant and convey 11 the following described tracts of land and the improvements 12 erected thereon: 13 All those certain tracts or parcels of land, with 14 improvements thereon erected, situate in Hartley Township, Union 15 County, Pennsylvania, more particularly bounded and described as 16 follows: 17 TRACT 1 18 Beginning at an existing steel pin and stones located on or 19 near the northern right of way of S.R. 0045 and on the
1 jurisdictional division line between lands of the Commonwealth 2 of Pennsylvania, Bureau of Forestry and lands of the 3 Commonwealth of Pennsylvania, Department of Public Welfare. 4 Thence along lands of the Commonwealth of Pennsylvania, 5 Bureau of Forestry by the 4 following courses and distances; 6 1. North 22 degrees 29 minutes 55 seconds East, 3685.15 7 feet, to an existing witnessed stone pile; 8 2. The tracts under section 1 or parts thereof may 17 be offered together or separately. 18 Section 3. Notwithstanding the provisions of Article XXIV-A 19 of the act of April 9, 1929 (P.L.177, No.175), known as The 20 Administrative Code of 1929, the Department of General Services 21 shall, through sealed bids, auction or request for proposal 22 select the purchaser of the tracts and sell the property under 23 section 1. Acceptance of an offer shall be subject to a minimum 24 price requirement as established by the department which shall 25 be within a range of fair market value as established through 26 independent appraisal. Proposals submitted in response to a 27 request for proposal must demonstrate a value to the 28 Commonwealth equivalent to the fair market value range as 29 established by the department through independent appraisal. In 30 establishing the value equivalent the department shall consider 19970H2000B2602 - 7 -
1 the following factors: actual monetary consideration, creation 2 of construction jobs, creation of permanent jobs, expansion of 3 local tax base, economic growth, community development, highest 4 and best use, and public purpose. 5 Section 4. The conveyance shall be made under and subject to 6 all easements, servitudes and rights of others, including, but 7 not confined to, streets, roadways and rights of any telephone, 8 telegraph, water, electric, sewer, gas or pipeline companies, as 9 well as under the subject to any interest, estates or tenancies 10 vested in third persons, whether or not appearing of record, for 11 any portion of the land or improvements erected thereon. 12 Section 5. The proceeds of the conveyances shall be paid 13 into the State Treasury and deposited in the General Fund. 14 Section 6. The deed of conveyance shall be approved as 15 provided by law and shall be executed by the Secretary of 16 General Services in the name of the Commonwealth of 17 Pennsylvania. 18 Section 7. Costs and fees incurred by the Department of 19 General Services for preparing the property under section 1 for 20 sale, including, but not limited to, environmental assessments, 21 marketing services, title searches, advertising, appraisals, 22 auctioneer fees and surveys, and by the Department of Public 23 Welfare for protecting and securing the property shall be 24 deducted from the purchase price and that amount shall be an 25 executively authorized augmentation to the appropriation from 26 which the costs and fees were paid by the departments, with 27 priority reimbursements being made to Department of General 28 Services and then Department of Public Welfare. 29 Section 8.
