                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, further providing for telephone
     3     solicitation for public utility services.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 66 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 1512.  Telephone solicitation for public utility service.
     9     (a)  Telephone solicitation prohibited.--A public utility or
    10  an affiliate of a public utility or an entity in the business of
    11  providing a public utility service shall not initiate a
    12  telephone call to any residential telephone line in this
    13  Commonwealth by using voice or artificial or prerecorded voice
    14  or by any other means for the purpose of soliciting the purchase
    15  of any public utility service unless the called party
    16  specifically gave prior written consent authorizing the
    17  telephone solicitation.
    18     (b)  Definitions.--As used in this section, the following

     1  words and phrases shall have the meanings given to them in this
     2  subsection:
     3     "Entity in the business of providing a public utility
     4  service."  Any marketer, broker, aggregator, reseller, electric
     5  generator, gas producer, gas transmission company or affiliate
     6  thereof. The term shall not include any entity which is
     7  initiating telephone calls to its own members for the purpose of
     8  soliciting the purchase of any public utility service,
     9  including, but not limited to, a political subdivision, a group
    10  or association representing political subdivisions, a Statewide
    11  farm organization, a chamber of commerce, a labor organization
    12  or a nonprofit corporation subject to Title 15 (relating to
    13  corporations and unincorporated associations).
    14     "Public utility service."  Any telephone, electric or gas
    15  service for which the consumer is permitted to choose the
    16  provider of that service from a public utility, affiliate of a
    17  public utility or entity in the business of providing a public
    18  utility service.
    19     Section 2.  This act shall take effect in 60 days.
