                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
     2     "An act concerning elections, including general, municipal,
     3     special and primary elections, the nomination of candidates,
     4     primary and election expenses and election contests; creating
     5     and defining membership of county boards of elections;
     6     imposing duties upon the Secretary of the Commonwealth,
     7     courts, county boards of elections, county commissioners;
     8     imposing penalties for violation of the act, and codifying,
     9     revising and consolidating the laws relating thereto; and
    10     repealing certain acts and parts of acts relating to
    11     elections," providing for automatic recounts.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  The act of June 3, 1937 (P.L.1333, No.320), known
    15  as the Pennsylvania Election Code, is amended by adding a
    16  section to read:
    17     Section 1704.  Automatic Recounts.--
    18     (a)  If, after an initial tally of ballots in a particular
    19  race the number of votes cast for the leading candidate and the
    20  number of votes cast for the second place candidate is less than


     1  one per centum of the total votes cast and the margin of votes
     2  between the two candidates is less than one thousand (1,000)
     3  votes, there will be an automatic recount of the total votes
     4  cast in that race.
     5     (b)  Recounts under this section shall be made by each county
     6  board of elections in the respective county in which each
     7  recount will occur. All expenses of a recount under this section
     8  shall be paid by the Commonwealth.
     9     Section 2.  This act shall take effect in 60 days.
