                                     AN ACT

     1  Amending Title 53 (Municipalities Generally) of the Pennsylvania
     2     Consolidated Statutes, further providing for the governing
     3     body of an authority.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 5610(b) of Title 53 of the Pennsylvania
     7  Consolidated Statutes added June 19, 2001 (P.L.  , No.22), is
     8  amended to read:
     9  § 5610.  Governing body.

    11     (b)  Residency.--Except as provided for in subsection (c),
    12  the members of the board, each of whom shall be a [resident]
    13  taxpayer in, maintain a business in or be a citizen of the
    14  municipality by which he is appointed or be a taxpayer in,
    15  maintain a business in or be a citizen of a municipality into


     1  which one or more of the projects of the authority extends or is
     2  to extend or to which one or more projects has been or is to be
     3  leased, shall be appointed, their terms fixed and staggered and
     4  vacancies filled, pursuant to the articles of incorporation or
     5  the application of membership under section 5604 (relating to
     6  municipalities withdrawing from and joining in joint
     7  authorities). Where two or more municipalities are members of
     8  the authority, they shall be apportioned pursuant to the
     9  articles of incorporation or the application for membership
    10  under section 5604. Except for special service districts located
    11  in whole or in part in cities of the first class, a majority of
    12  an authority's board members shall be citizens residing in the
    13  incorporating municipality or incorporating municipalities of
    14  the authority.
