AN ACT

Amending the act of August 7, 1936 (1st Sp.Sess., P.L.106, No.

2

46), entitled, as reenacted and amended, "An act relating to

3

flood control; prescribing the powers and duties of the Water

4

and Power Resources Board of the Department of Forests and

5

Waters in relation to the creation of flood control

6

districts, adoption of plans for flood control works and

7

improvements, carrying into effect of such plans, assistance,

8

aid and cooperation with public and private agencies and the

9

Federal Government in Federal flood control works and

10

improvements, and entering into compacts and agreements with

11

other states for flood control works and improvements;

12

conferring the power of eminent domain; providing for the

13

setting off of benefits; imposing certain charges upon the

14

Commonwealth; providing for appeals; and conferring certain

15

powers on municipalities, counties, and townships, and the

16

Department of Highways," providing for contracts to promote

17

participation.

The General Assembly of the Commonwealth of Pennsylvania

19

hereby enacts as follows:

20

Section 1.  The act of August 7, 1936 (1st Sp.Sess., P.L.106,

21

No.46), referred to as the Flood Control Law, reenacted and

22

amended March 10, 1937 (P.L.43, No.18), is amended by adding a

23

section to read:

Section 10.2.  Contracts to Promote Participation.--(a)  The

25

board shall develop, adopt and implement binding policies or

guidelines to ensure that all persons are accorded equal

2

opportunity in contracting and subcontracting associated with

3

every contract for the construction, reconstruction, alteration,

4

repair, improvement or maintenance of public works authorized

5

under this act.

(b)  Every contract for or on behalf of the board for the

7

construction, reconstruction, alteration, repair, improvement or

8

maintenance of public works authorized under this act shall

9

contain provisions by which the contractor agrees to promote,

10

increase and sustain contracting and subcontracting

11

opportunities for disadvantaged businesses.

12

(c)  This section shall apply to:

13

(1)  Any contract for or on behalf of the board which is

14

subject to advertisement and competitive bidding.

15

(2)  All board contractors, subcontractors, assignees,

16

lessees, agents, vendors and suppliers.

17

(3)  Any disadvantaged business.

18

(d)  The board may use the lists of certified minority-owned,

19

women-owned and veteran-owned business enterprises which have

20

been certified under the Department of General Services'

21

disadvantaged business program to compete for and participate in

22

the board's contracting process. The Department of General

23

Services shall cooperate with and assist the board in carrying

24

out the requirements of this subsection.

25

(e)  For the purpose of this section, the following words and

26

phrases shall have the meaning given to them in this subsection

27

unless the context clearly indicates otherwise:

28

"Disadvantaged business."  A small business which is owned or

29

controlled by a majority of persons, not limited to members of

30

minority groups, who:

(1)  have been deprived of the opportunity to develop and

2

maintain a competitive position in the economy because of social

3

disadvantages; or

4

(2)  are veterans, including service-disabled veterans.

5

"Service-disabled veteran."  A veteran who possesses either

6

an adjudication letter from the Department of Veterans Affairs

7

establishing a service-connected disability rating or a

8

disability determination from the Department of Defense.

9

"Small business."  The term shall have the meaning given to

10

it in 62 Pa.C.S. § 2102 (relating to definitions).

11

"Veteran."  An individual who:

12

(1)  served in the active United States military in any of

13

the four current branches and all previous branches, including a

14

reserve component or the National Guard;

15

(2)  was released or discharged from active military service

16

under conditions other than dishonorable; and

17

(3)  possesses a certificate of release or discharge from

18

active duty.

Section 2.  This act shall take effect in 60 days.
