                                     AN ACT

     1  Amending the act of June 11, 1935 (P.L.326, No.149), entitled
     2     "An act relating to counties of the first class; defining
     3     deceased service persons; providing for contributions by the
     4     county to the funeral expenses for such persons and their
     5     widows; providing for the erection and care of markers,
     6     headstones, and flags, and for the compilation of war
     7     records," changing the duties of undertakers relating to
     8     certain payments for deceased veterans and spouses.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 4, act of June 11, 1935 (P.L.326,
    12  No.149), entitled "An act relating to counties of the first
    13  class; defining deceased service persons; providing for
    14  contributions by the county to the funeral expenses for such
    15  persons and their widows; providing for the erection and care of
    16  markers, headstones, and flags, and for the compilation of war
    17  records," amended November 5, 1971 (P.L.512, No.121), is amended
    18  to read:
    19     Section 4.  Payments.--It shall be the duty of each such
    20  county in this State to draw a warrant upon the treasurer of


     1  their county in the sum of seventy-five dollars ($75.00), or one
     2  hundred dollars ($100.00) if the additional sum of twenty-five
     3  dollars ($25.00) is authorized, for each body buried in
     4  accordance with the provisions of this act, to be paid out of
     5  the funds of the county, and such warrants shall be made payable
     6  to the applicant or applicants if the application shows that the
     7  funeral expenses have been paid, otherwise to the undertaker
     8  performing the services, with notice to the applicant.
     9     Application for such contribution shall be made by the
    10  personal representative of such deceased service person or
    11  deceased service person's widow, if there be such personal
    12  representative, if no such personal representative has
    13  qualified, then by any next of kin, individual or veterans'
    14  organization who, or which, assumes responsibility for the cost
    15  of burial of the body, and shall be sustained by affidavit as to
    16  the facts.
    17     Such application shall be on forms prescribed by the
    18  Department of Military Affairs, and shall set forth whether or
    19  not the funeral expenses have been paid. The application shall
    20  have attached thereto, a certified copy of the death
    21  certificate, and [an affidavit] a certification by the
    22  undertaker, who had charge of the burial of the body, and to the
    23  effect that the undertaker did render such service.
    24     Section 2.  This act shall take effect immediately.
