| AN ACT |
| |
1 | Amending the act of April 21, 1949 (P.L.665, No.155), entitled |
2 | "An act to carry into effect section one of article fifteen |
3 | of the Constitution, giving cities of the first class the |
4 | right and power to frame, adopt and amend their own charters |
5 | and to exercise the powers and authority of local self- |
6 | government, and providing the procedure therefor; imposing |
7 | certain restrictions, limitations and regulations; imposing |
8 | duties upon city councils, city officers, county boards of |
9 | elections, courts and the Secretary of the Commonwealth; and |
10 | providing for the payment of certain expenses by such cities; |
11 | and imposing penalties," further providing for provisions |
12 | relating to specific powers. |
13 | The General Assembly of the Commonwealth of Pennsylvania |
14 | hereby enacts as follows: |
15 | Section 1. Section 17.1 of the act of April 21, 1949 |
16 | (P.L.665, No.155), known as the First Class City Home Rule Act, |
17 | added November 30, 2004 (P.L.1523, No.193), is amended to read: |
18 | Section 17.1. Specific Powers.--In addition to any aggrieved |
19 | person, the governing body vested with legislative powers under |
20 | any charter adopted pursuant to this act shall have standing to |
21 | appeal any decision of a zoning hearing board or other board or |
22 | commission created to regulate development within the city. [As |

1 | used in this section, the term "aggrieved person" does not |
2 | include taxpayers of the city that are not detrimentally harmed |
3 | by the decision of the zoning hearing board or other board or |
4 | commission created to regulate development.] Nothing in this act |
5 | shall be deemed to restrict the standing of any person or |
6 | persons to appeal decisions of a zoning hearing board or other |
7 | board or commission granted by any existing or future ordinance |
8 | of a city of the first class. |
9 | Section 2. The amendment of section 17.1 of the act shall |
10 | apply to any action of a governing body after November 30, 2004. |
11 | Section 3. This act shall take effect immediately. |
