                                     AN ACT

     1  Amending Title 71 (State Government) of the Pennsylvania
     2     Consolidated Statutes, further providing for creditable
     3     nonstate service.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 5304(a) of Title 71 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 5304.  Creditable nonstate service.
     9     (a)  Eligibility.--An active member or a multiple service
    10  member who is a school employee and an active member of the
    11  Public School Employees' Retirement System shall be eligible for
    12  Class A service credit for creditable nonstate service as set
    13  forth in subsections (b) and (c) except that [intervening]:
    14         (1)  Intervening military service shall be credited in
    15     the class of service for which the member was eligible at the
    16     time of entering into military service and for which he makes
    17     the required contributions and except that a multiple service

     1     member who is a school employee and an active member of the
     2     Public School Employees' Retirement System shall not be
     3     eligible to purchase service credit for creditable nonstate
     4     service set forth in subsection (c)(5).
     5         (2)  Nonintervening military service shall be credited in
     6     the class of service for which the member is eligible at the
     7     time he elects to purchase nonintervening military service
     8     credit and for which he makes the required contributions.

    10     Section 2.  This act shall take effect in 60 days.
