AN ACT 1 Amending Title 66 (Public Utilities) of the Pennsylvania 2 Consolidated Statutes, further providing for billing 3 procedures. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 1509 of Title 66 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 1509. Billing procedures. 9 All bills rendered by a public utility as defined in 10 paragraph (1)(i), (ii), (vi) or (vii) of the definition of 11 "public utility" in section 102 (relating to definitions) to its 12 service customers, except bills for installation charges, shall 13 allow at least 15 days for nonresidential customers and 20 days 14 for residential customers from the date of transmittal of the 15 bill for payment without incurring any late payment penalty 16 charges therefor. All customers shall be permitted to receive 17 bills monthly and shall be notified of their right thereto. All 18 bills shall be itemized to separately show amounts for basic
1 service, Federal excise taxes, applicable State sales and gross 2 receipts taxes, to the extent practicable, fuel adjustment 3 charge, if any, State tax adjustment charge or such other 4 similar components of the total bill as the commission may 5 order. Any electric or gas public utility billing customers on a 6 bimonthly [or], quarterly or seasonal basis and rendering 7 interim statements or bills each month shall include in such 8 interim statement or bill the seasonal factor percent for the 9 applicable billing period and amount for the fuel adjustment 10 charge based upon one-half of the total expected bimonthly 11 kilowatt hour or cubic foot billing or one-third of the total 12 expected quarterly billing and using the fuel adjustment charge 13 rate applicable in the month of the interim statement or bill. 14 At the time of preparing the bimonthly or quarterly bill, an 15 appropriate adjustment shall be made in the total fuel 16 adjustment charge billing for the period. Any public utility 17 rendering bills on a bimonthly [basis or], quarterly or seasonal 18 basis shall calculate the fuel adjustment charge per kilowatt 19 hour or cubic foot for the entire period as the weighted average 20 of the two monthly rates or the three monthly rates whichever is 21 applicable. 22 Section 2. All acts and parts of acts are repealed insofar 23 as they are inconsistent with this act. 24 Section 3. This act shall take effect in 60 days. A3L66JS/20000H2231B2924 - 2 -
