AN ACT
Amending Titles 8 (Boroughs and Incorporated Towns) and 11
(Cities) of the Pennsylvania Consolidated Statutes, in
powers, duties and rights of appointed officers and
employees, further providing for council's powers concerning
police; and, in police force, further providing for
appointment, number, rank, compensation and qualifications of
police officers.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 1121(a) of Title 8 of the Pennsylvania
Consolidated Statutes is amended by adding a paragraph and the
section is amended by adding a subsection to read:
§ 1121. Council's powers concerning police.
(a) Establishment of police department.--Council may, by
ordinance, establish a police department. If council establishes
a police department, the following shall apply:

(6) The police department shall operate as a full-time
police department.

(e ) Definitions.--As used in this section, the following

words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"Full-time police department." A police force that maintains
24-hour-per-day police coverage in its designated area.
Section 2. Section 12001(a) of Title 11 is amended and the
section is amended by adding a subsection to read:
§ 12001. Appointment, number, rank, compensation and
qualifications of police officers.
(a) General rule.--
(1) Council shall fix, by ordinance, the number, grades
and compensation of the members of the city police force, who
shall, except as provided in section 12002 (relating to
designation of chief), be appointed in accordance with the
civil service provisions of this chapter.
(2) The city police office shall operate as a full-time
police department.

(e) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"Full-time police department." A police force that maintains
24-hour-per-day police coverage in its designated area.
Section 3. This act shall take effect in 60 days.
