                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further defining possession of an
     3     instrument of crime.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 907(c) of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 907.  Possessing instruments of crime.
     9     * * *
    10     (c)  Definitions.--As used in this section the following
    11  words and phrases shall have the meanings given to them in this
    12  subsection:
    13     "Instrument of crime."
    14         (1)  Anything specially made or specially adapted for
    15     criminal use; or
    16         (2)  anything commonly used for criminal purposes and
    17     possessed by the actor under circumstances not manifestly


     1     appropriate for lawful uses it may have. This shall include,
     2     but not be limited to, common burglary tools, tire irons,
     3     stun guns and baseball bats.
     4     "Weapon."  Anything readily capable of lethal use and
     5  possessed under circumstances not manifestly appropriate for
     6  lawful uses which it may have. The term includes a firearm which
     7  is not loaded or lacks a clip or other component to render it
     8  immediately operable, and components which can readily be
     9  assembled into a weapon.
    10     Section 2.  This act shall take effect immediately.
