AN ACT 1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania 2 Consolidated Statutes, further providing for persons not to 3 possess, use, manufacture, control, sell or transfer firearms 4 and licenses. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. The heading of section 6105 of Title 18 of the 8 Pennsylvania Consolidated Statutes, amended November 10, 2005 9 (P.L.335, No.66), is amended and subsection (a) is amended by 10 adding a paragraph to read: 11 § 6105. Persons not to purchase, possess, use, manufacture, 12 control, sell or transfer firearms. 13 (a) Offense defined.-- 14 * * * 15 (1.1) A person who is the defendant in an active 16 protection from abuse order issued pursuant to 23 Pa.C.S. § 17 6108 (relating to relief) shall be prohibited from 18 possessing, acquiring or purchasing any firearm during the
1 period of time the order is in effect. The order shall 2 require that all firearms in the possession of the defendant, 3 including firearms used by the defendant in the defendant's 4 employment, shall be delivered to the sheriff's department of 5 the county in which the order was issued. This prohibition 6 shall terminate upon the expiration or vacation of an active 7 protection from abuse order. 8 * * * 9 Section 2. Section 6109(e)(1) of Title 18 is amended by 10 adding a subparagraph to read: 11 § 6109. Licenses. 12 * * * 13 (e) Issuance of license.-- 14 (1) A license to carry a firearm shall be for the 15 purpose of carrying a firearm concealed on or about one's 16 person or in a vehicle and shall be issued if, after an 17 investigation not to exceed 45 days, it appears that the 18 applicant is an individual concerning whom no good cause 19 exists to deny the license. A license shall not be issued to 20 any of the following: 21 * * * 22 (xv) An individual who is the defendant in an active 23 protection from abuse order issued pursuant to 23 Pa.C.S. 24 § 6108 (relating to relief). 25 * * * 26 Section 3.
