AN ACT 1 Amending Title 74 (Transportation) of the Pennsylvania 2 Consolidated Statutes, providing for public transportation 3 supplemental assistance funding; and making an appropriation. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 1310 of Title 74 of the Pennsylvania 7 Consolidated Statutes is amended by adding a subsection to read: 8 § 1310. Distribution of funding. 9 * * * 10 (h) Distribution of supplemental public transportation 11 assistance funding.--
1 (1) Any amounts appropriated or otherwise paid into the 2 Public Transportation Assistance Fund and designated for 3 distribution for public transportation supplemental 4 assistance funding pursuant to this subsection shall be 5 distributed in accordance with the provisions of this 6 subsection. Funds distributed in accordance with this 7 subsection may be used for any of the purposes enumerated in 8 section 1311 without regard to any limits as to the amount or 9 percentage of funds to be utilized for specific purposes. 10 Each local transportation organization or transportation 11 company may use its base supplemental assistance share for 12 capital projects, asset maintenance or other programs 13 specified in this chapter and for general operations. Each 14 month the Treasury Department shall pay to each local 15 transportation organization or transportation company 1/12 of 16 the base supplemental assistance share of that local 17 transportation organization or transportation company. Any 18 additional funds appropriated or otherwise paid into the 19 Public Transportation Assistance Fund and designated for 20 distribution for public transportation supplemental 21 assistance funding pursuant to this subsection shall be added 22 to the funds available for distribution under this section, 23 other than this subsection, and distributed in accordance 24 with the formula otherwise specified in this section. 25 (2) As used in this subsection, the following words and 26 phrases shall have the meanings given to them in this 27 paragraph: 28 "Base supplemental assistance share." 1 $54,616,000. 2 "P.L.103-122 percentage." The percentage determined 3 by dividing: 4 (i)(A) the operating assistance grant or operating 5 assistance limitation, whichever is greater, but not 6 to exceed the total apportionment of funds made 7 available to a particular local transportation 8 organization or transportation company in this 9 Commonwealth for each Class 1 transit entity, Class 2 10 transit entity and Class 3 transit entity pursuant to 11 Public Law 103-122, 107 Stat. 1199; or 12 (B) the base grants approved for each Class 4 13 transit entity pursuant to Public Law 103-122 for the 14 Federal fiscal year ending September 30, 1994; by 15 (ii) the total of such amounts for all Pennsylvania 16 local transportation organizations and transportation 17 companies pursuant to Public Law 103-122 for such fiscal 18 year, as determined by the department. 19 Section 2. The sum of $54,616,000 is hereby appropriated for 20 the fiscal year July 1, 1995, to June 30, 1996, from the General 21 Fund to the Public Transportation Assistance Fund and is hereby 22 designated for public transportation supplemental assistance 23 funding pursuant to 74 Pa.C.S. § 1310(h). 24 Section 3.
