                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for sale or transfer
     3     of firearms; providing for registry for lost or stolen
     4     firearms; further providing for registration of firearms; and
     5     providing for failure to report lost or stolen firearm and
     6     for notice of multiple purchase reporting.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 6111 of Title 18 of the Pennsylvania
    10  Consolidated Statutes is amended by adding a subsection to read:
    11  § 6111.  Sale or transfer of firearms.

    13     (c.1)  Multiple purchases.--Each licensed importer, licensed
    14  manufacturer or licensed dealer of firearms shall prepare a
    15  report of multiple sales or other dispositions of firearms
    16  whenever that licensee sells or otherwise disposes of, at one
    17  time or during any five consecutive business days, two or more
    18  firearms or any combination of firearms totaling two or more, to
    19  any person. The report shall be prepared on a form specified by

     1  the Pennsylvania State Police and shall be forwarded to the
     2  sheriff of the county in which the person resides not later than
     3  the close of business on the day that the multiple sale or other
     4  disposition occurs.

     6     Section 2.  Section 6111.1(b) of Title 18 is amended by
     7  adding a paragraph to read:
     8  § 6111.1.  Pennsylvania State Police.

    10     (b)  Duty of Pennsylvania State Police.--
    11         * * *
    12         (5)  The Pennsylvania State Police shall maintain a
    13     registry of all firearms reported lost or stolen in this
    14     Commonwealth. The registry shall contain, if available, the
    15     manufacturer, model, caliber, serial number and any other
    16     identifying information concerning any firearm reported lost
    17     or stolen, as well as the name of the lawful owner of the
    18     firearm. If a firearm is reported stolen to a local law
    19     enforcement agency, that agency shall collect the required
    20     information and shall submit it to the Pennsylvania State
    21     Police.

    23     Section 3.  Section 6111.4 of Title 18 is amended to read:
    24  § 6111.4.  Registration of firearms.
    25     Notwithstanding any section of this chapter to the contrary,
    26  nothing in this chapter shall be construed to allow any
    27  government or law enforcement agency or any agent thereof to
    28  create, maintain or operate any registry of firearm ownership
    29  within this Commonwealth, other than a registry of firearms
    30  reported lost or stolen under section 6111.1(b)(5) (relating to

     1  Pennsylvania State Police). For the purposes of this section
     2  only, the term "firearm" shall include any weapon that is
     3  designed to or may readily be converted to expel any projectile
     4  by the action of an explosive or the frame or receiver of any
     5  such weapon.
     6     Section 4.  Title 18 is amended by adding a section to read:
     7  § 6127.  Failure to report lost or stolen firearm and notice of
     8             multiple purchase reporting.
     9     (a)  Offense defined.--A person who is the owner of a firearm
    10  that is lost or stolen and who fails, within 48 hours after the
    11  theft or loss is discovered, to report the loss or theft to an
    12  appropriate local law enforcement official commits a summary
    13  offense.
    14     (b)  Duty to forward report to sheriff.--A local law
    15  enforcement official, or his designee, who receives a report
    16  under subsection (a) shall forward a copy of the report to the
    17  sheriff of the county in which the complainant or victim resides
    18  within 48 hours.
    19     (c)  Order.--Notwithstanding any other penalty prescribed by
    20  law, the court may enter an order prohibiting a person convicted
    21  for a violation of this section from the purchase or any other
    22  method of acquiring any firearm for a period of six months. Any
    23  order entered pursuant to this section shall be transmitted to
    24  the Pennsylvania State Police within 48 hours.
    25     (d)  Notice.--Each licensed importer, licensed manufacturer
    26  or licensed dealer of firearms shall post, in a conspicuous
    27  place, a notice which states that multiple purchases of firearms
    28  within a five-business-day period will be reported to law
    29  enforcement under section 6111(c.1) (relating to sale or
    30  transfer of firearms).
