AN ACT 1 Authorizing and directing the Department of Conservation and 2 Natural Resources, with the approval of the Governor, to 3 convey to William Peter R. Cross and/or his assigns a certain 4 tract of land situated in Whitemarsh Township, Montgomery 5 County, in exchange for a certain tract of land. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Authorization. 9 The Department of Conservation and Natural Resources, with 10 the approval of the Governor, is hereby authorized and directed 11 on behalf of the Commonwealth of Pennsylvania to grant and 12 convey to William Peter R. Cross and/or his assigns the 13 following tract of land bounded and described as follows: 14 All that certain lot, piece or parcel of land situated in the 15 Township of Whitemarsh, County of Montgomery, Commonwealth of 16 Pennsylvania bounded and described as follows: 17 BEGINNING at a point corner to Tax Lot 4 in Block 56 and Tax 18 Lot 5 in Block 56, said point beginning distant South 45 degrees 19 05 minutes 00 seconds East, a distance of 1,174.90 feet from a
1 point in the existing easterly right of way line of Bethlehem 2 Pike, said point at Bethlehem Pike being a common corner to Tax 3 Lot 4 in Block 56 and Tax Lot 5 in Block 56, and running thence; 4 along the aforementioned common line of Lots 4 and 5, North 45 5 degrees 49 minutes 50 seconds East, a distance of 63.80 feet to 6 a point thence; leaving said common line and crossing Lot 4, 7 North 86 degrees 34 minutes 10 seconds West, a distance of 96.3 8 feet to a point in the first mentioned common line thence along 9 the same, South 45 degrees 05 minutes 00 seconds East, a 10 distance of 71.12 feet to the point and place of beginning. 11 CONTAINING 2,268.5 square feet of land, more or less as shown 12 on a plan prepared and surveyed by Andersen Engineering 13 Associated Incorporated. 14 Being a portion of Block 56, Lot 4, as contained in the deed 15 from Isaac Isard to the Commonwealth of Pennsylvania dated 16 December 30, 1931, and recorded in Montgomery County Deed Book 17 1137, Page 570. 18 Section 2. Property to be conveyed to Commonwealth. 19 The conveyance authorized by section 1 shall be in exchange 20 for the conveyance by William Peter R. Cross and/or his assigns 21 to the Commonwealth of Pennsylvania of a tract of land bounded 22 and described as follows: 23 All that certain tract of land situated in the Township of 24 Whitemarsh, County of Montgomery, and the Commonwealth of 25 Pennsylvania, more particularly bounded and described as 26 follows: 27 BEGINNING at a point in the common line between Tax Lot 4 in 28 Block 56 and Tax Lot 5 in Block 56, said point being distant 29 South 45 degrees 05 minutes 00 seconds East, a distance of 30 600.23 feet from a point in the existing easterly right of way 20000H2463B3343 - 2 -
1 line of Bethlehem Pike, said point at Bethlehem Pike being a 2 corner common to Tax Lot 4 in Block 56 and Tax Lot 5 in Block 3 56, and running thence; South 45 degrees 05 minutes 00 seconds 4 East, a distance of 503.55 feet to a point thence; North 86 5 degrees 34 minutes 10 seconds West, a distance of 7.55 feet to a 6 point thence; North 45 degrees 05 minutes 00 seconds West, a 7 distance of 498.03 feet to a point thence; North 46 degrees 29 8 minutes 10 seconds East, a distance of 5.00 feet to the point 9 and place of beginning. 10 CONTAINING 2,504 square feet of land, more or less. 11 Being a portion of Block 56, Lot 5, Parcel "B" as contained 12 in the deed from William Peter R. Cross and Lee Carol L. Cross 13 to William Peter R. Cross dated January 23, 1998, and recorded 14 in Montgomery County Deed Book 5214, Page 897. 15 Section 3. Conditions of conveyance. 16 Conveyance of the land described in section 1 shall be made 17 under and subject to all easements, servitude and rights of 18 others, including, but not confined to, streets, roadways and 19 rights of telephone, telegraph, water, electric, sewer, gas or 20 pipeline companies, as well as under and subject to any 21 interest, estates or tenancies vested in third persons, whether 22 or not appearing of record, for any portion of the land or 23 improvements erected, thereon. 24 Section 4. Execution of deed. 25 The deed of conveyance of the property described in section 1 26 shall be approved as provided by law and shall be executed by 27 the Secretary of the Department of Conservation and Natural 28 Resources in the name of the Commonwealth of Pennsylvania. 29 Section 5.
