AN ACT 1 Amending the act of November 1, 1971 (P.L.495, No.113), 2 entitled, as amended, "An act providing for the compensation 3 of county officers in counties of the second through eighth 4 classes, for compensation of district attorneys in cities and 5 counties of the first class, for compensation of district 6 election officers in all counties, for the disposition of 7 fees, for filing of bonds in certain cases and for duties of 8 certain officers," further providing for the salary of jury 9 commissioners. 10 The General Assembly of the Commonwealth of Pennsylvania 11 hereby enacts as follows: 12 Section 1. Section 10.1 of the act of November 1, 1971 13 (P.L.495, No.113), entitled, as amended, "An act providing for 14 the compensation of county officers in counties of the second 15 through eighth classes, for compensation of district attorneys 16 in cities and counties of the first class, for compensation of 17 district election officers in all counties, for the disposition 18 of fees, for filing of bonds in certain cases and for duties of 19 certain officers," amended or added November 1, 1979 (P.L.246, 20 No.82) and December 18, 1984 (P.L.1067, No.212), is amended to
1 read: 2 Section 10.1. (a) From and after the effective date of this 3 section, the county commissioners shall have the power to fix 4 the salary of all county officers governed by the provisions of 5 this act. 6 (b) Salaries for all county officers governed by the 7 provisions of this act shall be fixed by the county 8 commissioners in the following manner: 9 (1) The county commissioners shall cause notice of intention 10 to fix salaries at a special public meeting on a date certain to 11 be published in a newspaper of general circulation at least ten 12 days in advance of such special public meeting. 13 (2) The special public meeting shall be held during the 14 hours of 6:00 P.M. and 9:00 P.M., prevailing time, so as to 15 afford the public the greatest opportunity to attend. 16 (3) The special public meeting shall be held in a centrally 17 located area of the county. 18 (c) [The] Except as provided in subsection (f), the county 19 commissioners shall not reduce the salary of any county officer 20 below the amount set forth in this act. 21 (d) No new salary schedule shall be adopted in a calendar 22 year in which the county commissioners are to be elected. 23 (e) Any salary increase shall be on a percentage basis and 24 applied equally to all county officials except that the county 25 commissioners may provide a greater percentage salary increase 26 to the lowest paid county official, other than the jury 27 commissioners or county auditor, until his salary is equal to 28 the other county officials except the jury commissioners, county 29 auditors, district attorneys and county commissioners. 30 (f) The county commissioners may reduce the salary of jury 19980H2653B3642 - 2 -
1 commissioners to such amount as they determine. Any reduction in 2 salary shall not take effect until after the conclusion of the 3 term of the jury commissioners during which the reduction is 4 adopted. 5 Section 2. This act shall take effect in 60 days. D27L16JS/19980H2653B3642 - 3 -
