                                     AN ACT

     1  Appropriating a portion of any unallocated surplus in the
     2     General Fund to the Department of Education for the purchase
     3     of textbooks for public school students.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Appropriation of unexpended and unencumbered
     7                 surplus.
     8     If the Secretary of the Budget certifies that there is a
     9  surplus of operating funds for the fiscal year 1999-2000 in the
    10  General Fund, and if a surplus continues to exist after the
    11  transfer under section 622 of the act of April 9, 1929 (P.L.177,
    12  No.175), known as The Administrative Code of 1929, then there is
    13  hereby appropriated to the Department of Education for the
    14  fiscal year 2000-2001 a sum of money not to exceed $35 per pupil
    15  for all public school pupils enrolled as of May 1, 2000, in the


     1  public schools to be distributed by the Department of Education
     2  to the public school districts on a per pupil basis and to be
     3  used for the purchase of new textbooks. These funds must be
     4  expended by December 31, 2001.
     5  Section 2.  Effective date.
     6     This act shall take effect immediately.
