AN ACT

Amending Title 53 (Municipalities Generally) of the Pennsylvania

2

Consolidated Statutes, in neighborhood blight reclamation and

3

revitalization, providing for divestiture of tax claims and

4

municipal liens upon agreement of governing bodies.

5

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  Section 6141 of Title 53 of the Pennsylvania

8

Consolidated Statutes is amended to read:

9

§ 6141.  [(Reserved).] Divestiture of tax claims and municipal

10

liens upon agreement of majority of governing bodies.

(a)  General rule.--A majority of the governing bodies of a

12

county, municipality and school district that levy real property

13

taxes on a property regarded as a public nuisance and targeted

14

for demolition may petition the court of common pleas for the

15

county in which the property is situated to divest all county,

16

municipal and school district tax claims and municipal liens

17

against the property if the governing body of each county,

18

municipality or school district represented in the majority have

adopted a resolution indicating that governing body's approval

2

of the divestiture of its tax claims and municipal liens against

3

the property and of the filing of the petition.

(b)  Attorney fees and court costs.--If not all of the

5

governing bodies of the county, municipality and school district

6

that levy real property taxes on the property have adopted a

7

resolution authorized under subsection (a), then the court shall

8

award attorney fees and court costs to the governing bodies that

9

represent the majority of the governing bodies which filed the

10

petition.

Section 2. This act shall take effect in 60 days.
