shall have the meanings given to them in this subsection unless
the context clearly indicates otherwise:
"Ballot question." An initiative, referendum, question,
recall measure or constitutional amendment certified to appear
on a ballot during an election.
Section 3. Section 1638(b)(3) of the act is amended and the
section is amended by adding subsections to read:
Section 1638. Advertising.--

(b) * * *
[(3) Any person, firm or corporation, political committee or
party or member thereof, violating any of the provisions of this
section, shall be guilty of a misdemeanor, and upon conviction
thereof, shall be sentenced to pay a fine not exceeding one
thousand dollars ($1,000), or to undergo an imprisonment of not
less than one (1) month nor more than two (2) years, or both, in
the discretion of the court.]
(c) A public body or a person acting for a public body may
not use public funds or resources for:
(1) Communications containing express words of advocacy,
such as "vote for," "vote against," "elect," "support," "cast
your ballot for," "cast your ballot against," "vote yes," "vote
no," "defeat" or "reject," regarding the election or defeat of a
clearly identified candidate.
(2) Communications containing express words of advocacy as
specified in paragraph (1) by means of radio, television,
Internet, mass mailing or prerecorded telephone message if the
communication references a ballot question.
(d) A person, firm, corporation, public body or person
acting for a public body, political committee or party or member
