AN ACT 1 Requiring pursuit intervention systems for motor vehicles; and 2 imposing penalties. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Short title. 6 This act shall be known and may be cited as the Pursuit 7 Intervention System Act. 8 Section 2. Definitions. 9 The following words and phrases when used in this act shall 10 have the meanings given to them in this section unless the 11 context clearly indicates otherwise: 12 "Motor vehicle." As defined in 75 Pa.C.S. § 102 (relating to 13 definitions). 14 "Pursuit intervention system. A high-speed avoidance system 15 capable of disabling and shutting down a motor vehicle's 16 electrical and fuel delivery system through a remote-generated, 17 law enforcement controlled laser activation device.
1 Section 3. Requirement. 2 (a) New motor vehicle.--A new motor vehicle may not be sold 3 or offered for sale in this Commonwealth unless it is equipped 4 by the manufacturer with a pursuit intervention system. 5 (b) Used motor vehicles.--A used motor vehicle may not be 6 sold or offered for sale in this Commonwealth unless it is 7 equipped with a pursuit intervention system. 8 Section 4. Authorization. 9 (a) General rule.--Except as provided in subsection (b), a 10 person may not activate a pursuit intervention system. 11 (b) Exception.--Subsection (a) does not apply to law 12 enforcement personnel. 13 Section 5. Penalties. 14 (a) Improper sale.--A person that violates section 3 commits 15 a summary offense. 16 (b) Unauthorized use.--A person that violates section 4 17 commits a misdemeanor of the third degree. 18 Section 20. Effective date. 19 This act shall take effect as follows: 20 (1) Section 3(a) shall take effect July 1, 2001. 21 (2) Section 3(b) shall take effect July 1, 2003. 22 (3) This section shall take effect immediately. 23 (4) The remainder of this act shall take effect in 60 24 days.
