AN ACT 1 Authorizing municipalities to establish municipal lotteries; 2 providing for requirements, limitations and restrictions; and 3 making repeals. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Definitions. 7 The following words and phrases when used in this act shall 8 have the meanings given to them in this section unless the 9 context clearly indicates otherwise: 10 "Municipality." A city, borough, incorporated town or 11 township or a home rule municipality formerly classified as a 12 city, borough, incorporated town or township. 13 Section 2. Municipalities authorized to establish municipal 14 lotteries. 15 Any municipality may, by ordinance, establish a lottery to be 16 operated by the municipality, the net proceeds of which shall be
1 used for the general operating expenses of the municipality. 2 Section 3. Requirements, limitations and restrictions. 3 (a) General rule.--Any lottery established by a municipality 4 shall be subject to the same general requirements, limitations 5 and restrictions as prescribed pursuant to the act of August 26, 6 1971 (P.L.351, No.91), known as the State Lottery Law. 7 (b) Approval required.--The proposed ordinance providing for 8 a lottery in a municipality and any subsequent changes in the 9 manner of conducting a lottery shall be submitted to the 10 Secretary of Revenue of the Commonwealth for his review as to 11 compliance with subsection (a) and shall be subject to his 12 approval. 13 Section 4. Other laws inapplicable. 14 No other law providing any penalty or disability for the sale 15 of lottery tickets or shares or any acts done in connection with 16 a lottery shall apply to the sale of tickets or shares or acts 17 performed with respect to a lottery authorized by this act. 18 Section 5. Repeals. 19 (a) Specific repeals.--Sections 5512 (relating to lotteries, 20 etc.), 5513 (relating to gambling devices, gambling, etc.) and 21 5514 (relating to pool selling and bookmaking) of Title 18 of 22 the Pennsylvania Consolidated Statutes are repealed insofar as 23 inconsistent with the provisions of this act. 24 (b) General repeals.--All other acts or parts of acts are 25 repealed insofar as inconsistent with the provisions of this 26 act. 27 Section 6.
