                                     AN ACT

     1  Authorizing and directing the Department of Conservation and
     2     Natural Resources, to convey a right-of-way to Elwood Kocher
     3     and Beatrice Kocher, his wife, over certain Project 70 Land
     4     Acquisition and Borrowing Act lands in Bushkill Township,
     5     Northampton County, Pennsylvania.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8  Section 1.  Conveyance in Bushkill Township, Northampton County.
     9     (a)  Authorization.--Pursuant to the requirements of section
    10  20(b) of the act of June 22, 1964 (Sp.Sess., P.L.131, No.8),
    11  known as the Project 70 Land Acquisition and Borrowing Act, the
    12  General Assembly authorizes and directs the Department of
    13  Conservation and Natural Resources to convey a right-of-way as
    14  described in subsection (b) to Elwood Kocher and Beatrice
    15  Kocher, his wife, and their heirs, executors and assigns over
    16  certain lands in Bushkill Township, Northampton County,
    17  Pennsylvania for consideration of $1.
    18     (b)  Property description.--The property to be conveyed
    19  pursuant to subsection (a) consists of 12,551.028 S.F. or .288

     1  acres more particularly described as follows:
     2  All that certain lot or tract of land situate in the Township of
     3  Bushkill, County of Northampton and Commonwealth of
     4  Pennsylvania, being more particularly bounded and described as
     5  follows:
     6     Beginning at a point on the Easterly line of land of the
     7  Commonwealth of Pennsylvania, Parcel G7-15-9, said point being
     8  located North 89 degrees 45 minutes 00 seconds West on the
     9  Westerly right of way line of Jacobsburg Road (L.R. 48040) and
    10  from said beginning point running thence:
    11         (1)  North 89 degrees 45 minutes 00 seconds West a
    12     distance of 250.17 feet to a point, thence;
    13         (2)  North 05 degrees 00 minutes 00 seconds East a
    14     distance of 50.17 feet to a point along the Southerly line of
    15     Parcel G7-15-8, thence;
    16         (3)  Along the Southerly line of Parcel G7-15-8 and
    17     Parcel G7-15-7, South 89 degrees 45 minutes 00 seconds East a
    18     distance of 250.17 feet to a point on the Westerly right of
    19     way line of Jacobsburg Road (L.R. 48040), thence;
    20         (4)  Along the Westerly right of way line of Jacobsburg
    21     Road (L.R. 48040), South 04 degrees 00 minutes 00 seconds
    22     West a distance of 50.17 feet to the point and place of
    23     beginning.
    24     (c)  Restrictions.--The right-of-way conveyed pursuant to
    25  this section shall be free of restrictions on use and alienation
    26  prescribed by section 20 of the Project 70 Land Acquisition and
    27  Borrowing Act.
    28     (d)  Easement.--The conveyance shall be made under and
    29  subject to all lawful and enforceable easements, servitudes and
    30  rights of others, including, but not confined to streets,

     1  roadways and rights of any telephone, telegraph, water,
     2  electric, gas or pipeline companies, as well as under and
     3  subject to any lawful and enforceable estates or tenancies
     4  vested in third persons appearing of record, for any portion of
     5  the land or improvements erected thereon.
     6     (f)  Execution.--The deed of conveyance shall be by Special
     7  Warranty Deed and shall be executed by the Secretary of
     8  Conservation and Natural Resources in the Commonwealth of
     9  Pennsylvania.
    10     (g)  Costs.--Costs and fees incidental to this conveyance
    11  shall be borne by the grantee.
    12     Section 2.  This act shall take effect in 60 days.
