                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for a Flight 93 Memorial registration
     3     plate; and establishing the Flight 93 Memorial Trust Fund.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 1361.  Flight 93 Memorial plate.
     9     The department, in consultation with the Flight 93 Memorial
    10  Organization, shall design a special Flight 93 Memorial
    11  registration plate. Upon application of any person, accompanied
    12  by a fee of $35 which shall be in addition to the annual
    13  registration fee, the department shall issue the plate for a


     1  passenger car, motor home, trailer or truck with a registered
     2  gross weight of not more than 9,000 pounds. The Flight 93
     3  Memorial Trust Fund shall receive $15 of each additional fee for
     4  this plate.
     5     Section 2.  Section 1905 of Title 75 is amended by adding a
     6  subsection to read:
     7  § 1905.  Payments to special funds.
     8     * * *
     9     (d)  Flight 93 Memorial Trust Fund.--Fifteen dollars of each
    10  fee received under section 1361 (relating to Flight 93 Memorial
    11  plate) shall be credited to the Flight 93 Memorial Trust Fund,
    12  established as follows:
    13         (1)  There is hereby established a special account in the
    14     State Treasury which shall be known as the Flight 93 Memorial
    15     Trust Fund. The purpose of the Flight 93 Memorial Trust Fund
    16     is to provide moneys for:
    17             (i)  The construction, operation and maintenance of a
    18         physical monument, to be located in Somerset County on or
    19         near the site where Flight 93 crashed on September 11,
    20         2001, to memorialize and honor the innocent victims who
    21         died aboard Flight 93.
    22             (ii)  Costs associated with operating and maintaining
    23         the monument site, including any programs conducted at
    24         the site for purposes of commemorating the victims of
    25         Flight 93 or for related educational or patriotic
    26         purposes.
    27         (2)  All moneys in the Flight 93 Memorial Trust Fund are
    28     hereby annually appropriated to the Department of General
    29     Services and may be expended for the purposes authorized
    30     under this subsection.

     1         (3)  Estimates of amounts to be expended under this
     2     subsection shall be submitted to the Governor by the
     3     Department of General Services for the Governor's approval.
     4         (4)  The State Treasurer shall not honor any requisition
     5     for expenditures by the Department of General Services in
     6     excess of estimates approved by the Governor or in excess of
     7     the amount available for the purposes for which the
     8     requisition was made, whichever is the lesser amount.
     9     Section 3.  This act shall take effect in 60 days.
