HOUSE BILL

        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           NOVEMBER 12, 2002

                                     AN ACT

     1  Amending the act of June 26, 2001 (P.L.755, No.77), entitled "An
     2     act establishing a special fund and account for money
     3     received by the Commonwealth from the Master Settlement
     4     Agreement with tobacco manufacturers; providing for home and
     5     community-based care, for tobacco use prevention and
     6     cessation efforts, for Commonwealth universal research
     7     enhancement, for hospital uncompensated care, for health
     8     investment insurance, for medical assistance for workers with
     9     disabilities, for regional biotechnology research centers,
    10     for the HealthLink Program, for community-based health care
    11     assistance programs, for PACE reinstatement and PACENET
    12     expansion, for medical education loan assistance and for
    13     percentage allocation and appropriation of moneys," further    <--
    14     providing for PACE reinstatement. EXTENDING ELIGIBILITY FOR    <--
    15     PACE AND PACENET.

    16     The General Assembly of the Commonwealth of Pennsylvania
    17  hereby enacts as follows:
    18     Section 1.  Section 2306 of the act of June 26, 2001
    19  (P.L.755, No.77), known as the Tobacco Settlement Act, is
    20  amended to read:
    21  Section 2306.  PACE reinstatement.
    22     Notwithstanding any other provision of law to the contrary,
    23  persons who, as of December 31, [2000] 2002, were enrolled in     <--


     1  the PACE program established pursuant to the act of August 14,
     2  1991 (P.L.342, No.36), known as the former Lottery Fund
     3  Preservation Act, shall remain eligible for the PACE program if
     4  the maximum income limit is exceeded due solely to a Social
     5  Security cost-of-living adjustment. Any person whose PACE
     6  eligibility has been terminated for this cause shall be
     7  retroactively reinstated commencing on the effective date of
     8  this section. [Eligibility in the PACE program pursuant to this
     9  section shall expire on December 31, 2002.]
    10     Section 2.  This act shall take effect in 60 days.             <--
    11     SECTION 2.  THE ACT IS AMENDED BY ADDING A SECTION TO READ:    <--
    12  SECTION 2306.1.  PACENET REINSTATEMENT.
    13     NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY,
    14  PERSONS WHO, AS OF DECEMBER 31, 2001, WERE ENROLLED IN THE
    15  PACENET PROGRAM ESTABLISHED PURSUANT TO SECTION 519 OF THE ACT
    16  OF AUGUST 26, 1971 (P.L.351, NO.91), KNOWN AS THE STATE LOTTERY
    17  LAW, SHALL REMAIN ELIGIBLE FOR THE PACENET PROGRAM IF THE
    18  MAXIMUM INCOME LIMIT IS EXCEEDED DUE SOLELY TO A SOCIAL SECURITY
    19  COST-OF-LIVING ADJUSTMENT. ANY PERSON WHOSE PACENET ELIGIBILITY
    20  HAS BEEN TERMINATED FOR THIS CAUSE SHALL BE RETROACTIVELY
    21  REINSTATED COMMENCING ON THE EFFECTIVE DATE OF THIS SECTION.
    22     SECTION 3.  THIS ACT SHALL TAKE EFFECT IMMEDIATELY.
