                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for reports and removal of abandoned
     3     vehicles within the boundaries of a city of the third class.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 7304.2.  Reports and removal of abandoned vehicles within the
     9             boundaries of a city of the third class.
    10     (a)  General rule.--The governing body of a city of the third
    11  class may by ordinance opt to enforce the provisions of this
    12  section. The ordinance shall designate which municipal agency or
    13  department is directed to handle the abandoned vehicle process.
    14  Following the adoption of an ordinance, the governing body shall
    15  file a copy of the ordinance with the department.
    16     (b)  Abandoned vehicles.--Any and all vehicles reported


     1  abandoned to the police department and/or the appropriate
     2  designated municipal agency or department that handles the
     3  abandoned vehicle and cargo process shall be investigated within
     4  five business days to determine if the reported vehicle is
     5  abandoned as defined in section 102 (relating to definitions).
     6  Upon the completion of the investigation, any and all reported
     7  vehicles that satisfy the requirements of the definition of
     8  "abandoned vehicle" shall be officially declared abandoned and
     9  removed within ten business days by the police department or by
    10  an authorized salvor pursuant to police or municipality
    11  directions. Proper notification of the removal of the vehicle
    12  shall be sent pursuant to section 7305 (relating to notice to
    13  owner and lienholders of abandoned vehicles).
    14     (c)  Certain vehicles.--Any and all vehicles found to be
    15  abandoned vehicles pursuant to subsection (a) and found to have
    16  a vehicle registration and an inspection sticker, both of which
    17  are expired for a period exceeding 90 days, shall be removed
    18  immediately by the police department or by an authorized salvor
    19  pursuant to police or municipality directions. Proper
    20  notification of the removal of the vehicle shall be sent
    21  pursuant to section 7305.
    22     Section 2.  This act shall take effect in 60 days.
