AN ACT

 

1Amending the act of April 9, 1929 (P.L.177, No.175), entitled
2"An act providing for and reorganizing the conduct of the
3executive and administrative work of the Commonwealth by the
4Executive Department thereof and the administrative
5departments, boards, commissions, and officers thereof,
6including the boards of trustees of State Normal Schools, or
7Teachers Colleges; abolishing, creating, reorganizing or
8authorizing the reorganization of certain administrative
9departments, boards, and commissions; defining the powers and
10duties of the Governor and other executive and administrative
11officers, and of the several administrative departments,
12boards, commissions, and officers; fixing the salaries of the
13Governor, Lieutenant Governor, and certain other executive
14and administrative officers; providing for the appointment of
15certain administrative officers, and of all deputies and
16other assistants and employes in certain departments, boards,
17and commissions; and prescribing the manner in which the
18number and compensation of the deputies and all other
19assistants and employes of certain departments, boards and
20commissions shall be determined," providing for contracting
21for State trooper services.

22The General Assembly of the Commonwealth of Pennsylvania
23hereby enacts as follows:

24Section 1.  The act of April 9, 1929 (P.L.177, No.175), known
25as The Administrative Code of 1929, is amended by adding a
26section to read:

27Section 714.  State Trooper Services Contractual Program.--


1(a)  A municipality or adjacent municipalities which, on the
2effective date of this section, do not have an organized police
3force may enter into an agreement with the Pennsylvania State
4Police for State trooper service. The municipality or
5municipalities must agree to pay for the State trooper service.

6(b)  In order to implement this section the Commissioner of 
7the Pennsylvania State Police may enter into agreements with 
8boroughs and townships for the furnishing of police protection 
9by one or more State troopers on a contractual basis at agreed 
10upon hours and locations. The contract price for the services 
11shall include only the labor and benefit costs of providing 
12police protection, however at not less than $65 per hour per 
13trooper. Moneys paid for the police services shall be credited 
14to a restricted account and used for the express purpose of 
15financing the services for which the contract price was paid. 
16For every 2,000 hours annually contracted one full-time trooper 
17would not be counted in determining the total number of officers 
18and enlisted members in the Pennsylvania State Police.

19(c)  The Pennsylvania State Police shall promulgate rules and
20regulations as may be necessary to implement this program and
21the contractual agreements authorized by this section. The rules
22and regulations shall:

23(1)  Require that as a prerequisite to contracting for the
24services of a State trooper, a municipality or municipalities
25shall adopt a resolution or ordinance authorizing the
26contractual arrangement with the Pennsylvania State Police for
27the payment by the municipality or municipalities of the costs
28set pursuant to this section incurred in connection with the
29provision of these services.

30(2)  Require State troopers to remain under the direct

1control of the Pennsylvania State Police with supervision to be
2provided by the commanding officer of the field installation
3having jurisdiction over the municipality or municipalities
4contracting for the State trooper services.

5(3)  Require that all organizational orders, regulations and
6directives by the Pennsylvania State Police apply with full
7force to the assigned State troopers.

8(4)  Require that the commander of the field installation
9shall not remove a State trooper assigned pursuant to this
10contractual program from his area of jurisdiction during
11assigned hours except in cases of emergency, in which case the
12governing body of the contracting municipality or municipalities
13shall be notified.

14(5)  Require State troopers to enforce 75 Pa.C.S (relating to
15vehicles), criminal laws of this Commonwealth and local
16ordinances relating to public safety pursuant to the agreement
17with the municipality or municipalities.

18Section 2.  This act shall take effect in 60 days.
