| AN ACT |
| |
1 | Amending Title 2 (Administrative Law and Procedure) of the |
2 | Pennsylvania Consolidated Statutes, in practice and procedure |
3 | of Commonwealth agencies, further providing for the contents |
4 | and service of adjudications. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 507 of Title 2 of the Pennsylvania |
8 | Consolidated Statutes is amended to read: |
9 | § 507. Contents and service of adjudications. |
10 | (a) General rule.--All adjudications of a Commonwealth |
11 | agency shall be in writing, shall contain findings and the |
12 | reasons for the adjudication, and shall be served upon all |
13 | parties or their counsel personally, or by mail. |
14 | (b) Effect of failed service.--Notwithstanding any other |
15 | provision of law, if a party or the party's counsel was not |
16 | served personally under subsection (a) and failed to meet the |
17 | applicable deadline for appeal of the Commonwealth agency's |
18 | adjudication, the party shall have the right to file an appeal |
19 | within 30 days after the party discovers that the Commonwealth |

2 | Section 2. This act shall take effect in 60 days. |
