| AN ACT |
| |
1 | Amending the act of April 9, 1929 (P.L.343, No.176), entitled, |
2 | as amended, "An act relating to the finances of the State |
3 | government; providing for the settlement, assessment, |
4 | collection, and lien of taxes, bonus, and all other accounts |
5 | due the Commonwealth, the collection and recovery of fees and |
6 | other money or property due or belonging to the Commonwealth, |
7 | or any agency thereof, including escheated property and the |
8 | proceeds of its sale, the custody and disbursement or other |
9 | disposition of funds and securities belonging to or in the |
10 | possession of the Commonwealth, and the settlement of claims |
11 | against the Commonwealth, the resettlement of accounts and |
12 | appeals to the courts, refunds of moneys erroneously paid to |
13 | the Commonwealth, auditing the accounts of the Commonwealth |
14 | and all agencies thereof, of all public officers collecting |
15 | moneys payable to the Commonwealth, or any agency thereof, |
16 | and all receipts of appropriations from the Commonwealth, |
17 | authorizing the Commonwealth to issue tax anticipation notes |
18 | to defray current expenses, implementing the provisions of |
19 | section 7(a) of Article VIII of the Constitution of |
20 | Pennsylvania authorizing and restricting the incurring of |
21 | certain debt and imposing penalties; affecting every |
22 | department, board, commission, and officer of the State |
23 | government, every political subdivision of the State, and |
24 | certain officers of such subdivisions, every person, |
25 | association, and corporation required to pay, assess, or |
26 | collect taxes, or to make returns or reports under the laws |
27 | imposing taxes for State purposes, or to pay license fees or |
28 | other moneys to the Commonwealth, or any agency thereof, |
29 | every State depository and every debtor or creditor of the |
30 | Commonwealth," providing for State-owned vehicle use. |

1 | The General Assembly of the Commonwealth of Pennsylvania |
2 | hereby enacts as follows: |
3 | Section 1. The act of April 9, 1929 (P.L.343, No.176), known |
4 | as The Fiscal Code, is amended by adding an article to read: |
5 | ARTICLE XV-B |
6 | STATE-OWNED VEHICLE USE |
7 | Section 1501-B. Definitions. |
8 | The following words and phrases when used in this article |
9 | shall have the meanings given to them in this section unless the |
10 | context clearly indicates otherwise: |
11 | "Department." The Department of General Services of the |
12 | Commonwealth. |
13 | "Official business." Work performed on behalf of the | <-- |
14 | Commonwealth as part of a State employee's job duties and |
15 | responsibilities. The term does not include travel between a |
16 | State employee's home and the State employee's primary |
17 | workplace. |
18 | "Personal use." The use of a State-owned vehicle for any |
19 | purpose other than for use for official business. |
20 | "State employee." The term does not include an elected |
21 | public official of the State government. |
22 | "State entity." A Commonwealth or judicial agency. | <-- |
23 | "State-owned vehicle." A vehicle that is owned by the |
24 | Commonwealth. The term shall not include vehicles used for law |
25 | enforcement purposes by persons that have arrest powers. | <-- |
26 | Section 1502-B. Assignment of vehicle. | <-- |
27 | No State employee shall be eligible for a long-term |
28 | assignment of a State-owned vehicle unless the State employee's |
29 | duties require the State employee to travel at least 1,200 miles |
30 | per month on average on official business. |

1 | Section 1503-B. Mileage log. |
2 | Any State employee who is assigned a State-owned vehicle |
3 | shall be required to maintain a monthly mileage log detailing |
4 | the State employee's use of the vehicle. |
5 | Section 1504-B. Log maintenance. |
6 | The department shall post and maintain the logs required by |
7 | this article on its Internet website in such a manner that the |
8 | logs can be searched, at a minimum, by department, the State |
9 | employee's full name, vehicle make and vehicle model. |
10 | Section 1505-B. Redaction. |
11 | Logs required by this article that are maintained by law |
12 | enforcement personnel may be redacted to the extent that |
13 | redaction is necessary to protect the following: |
14 | (1) The integrity of an ongoing criminal investigation. |
15 | (2) The identity of a State employee who performs |
16 | undercover law enforcement duties. |
17 | Section 1506-B. Reimbursement. |
18 | A State employee who is assigned a State-owned vehicle shall |
19 | reimburse the State a reasonable amount, proportional to the |
20 | State employee's use of the vehicle for personal use, for State- |
21 | provided insurance coverage and the cost of gasoline. |
22 | Section 1502-B. Vehicle registry. | <-- |
23 | The department and each State entity shall post and maintain |
24 | a list of State employees, contract employees and independent |
25 | contractors under its jurisdiction who are assigned a State- |
26 | owned vehicle on its respective Internet website. The list shall |
27 | include the State employee's, contract employee's and |
28 | independent contractor's name, State entity, title and year and |
29 | make of the State-owned vehicle. The list shall be updated every |
30 | 90 days, except that previous years' lists shall remain posted |

2 | Section 1507-B 1503-B. Official use license plate. | <-- |
3 | Any State-owned vehicle assigned to a State employee, | <-- |
4 | contract employee or independent contractor shall have an |
5 | official use license plate unless the State employee, contract | <-- |
6 | employee or independent contractor to whom that State-owned |
7 | vehicle is assigned performs undercover law enforcement duties. |
8 | Section 2. This act shall take effect in 60 days. |
