AN ACT
1Amending Title 23 (Domestic Relations) of the Pennsylvania
2Consolidated Statutes, in protection from abuse, further
3providing for arrest for violation of order.
4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:
6Section 1. Section 6113(c) of Title 23 of the Pennsylvania
7Consolidated Statutes is amended to read:
8§ 6113. Arrest for violation of order.

10(c) Procedure following arrest.--Subsequent to an arrest,
11the defendant shall be taken by the police officer or sheriff
12without unnecessary delay before [the] a court in the judicial
13district where the contempt is alleged to have occurred for the
14purpose of conducting a preliminary arraignment. [When that
15court is unavailable, the police officer or sheriff shall convey
16the defendant to a magisterial district judge designated as
17appropriate by local rules of court or, in the city of
18Pittsburgh, to a magistrate of the Pittsburgh Magistrates Court
1or, in counties of the first class, to the appropriate hearing
2officer. For purposes of procedure relating to arraignments for
3arrest for violation of an order issued under this chapter, the
4judges of Pittsburgh Magistrates Court shall be deemed to be
5magisterial district judges] The hearing officer may be a judge
6or magisterial district judge or, in a county of the first
7class, hearing officer.
