        INTRODUCED BY ERICKSON, WONDERLING, MADIGAN, MUSTO, RAFFERTY,
           KITCHEN, CORMAN, ROBBINS, RHOADES, COSTA, PILEGGI, KASUNIC,
           TARTAGLIONE, PIPPY, LOGAN, ORIE, BOSCOLA, D. WHITE AND WAUGH,
           FEBRUARY 1, 2005

        REFERRED TO LABOR AND INDUSTRY, FEBRUARY 1, 2005

                                     AN ACT

     1  Amending the act of June 24, 1976 (P.L.424, No.101), entitled,
     2     as amended, "An act providing for the payment of death
     3     benefits to the surviving spouse or children or parents of
     4     firefighters, ambulance service or rescue squad members, law
     5     enforcement officers or National Guard members killed in the
     6     performance of their duties," further providing for
     7     eligibility for benefits for members of certain ambulance
     8     services or rescue squads.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 1 of the act of June 24, 1976 (P.L.424,
    12  No.101), referred to as the Emergency and Law Enforcement
    13  Personnel Death Benefits Act, is amended by adding a subsection
    14  to read:
    15     Section 1.  * * *
    16     (c.1)  An ambulance service or rescue squad member working
    17  for a hospital shall be deemed to be acting in the performance
    18  of his duties for the purposes of this act attending, going to
    19  or directly returning from an emergency which the ambulance
    20  service or rescue squad attended, including travel from and

     1  direct return to the hospital or other place where the ambulance
     2  service or rescue squad is stationed. This subsection shall only
     3  apply to hospital employees who are directed to respond to
     4  emergencies pursuant to an agreement to provide emergency
     5  service coverage for a political subdivision.

     7     Section 2.  This act shall take effect in 60 days.
