SENATE RESOLUTION

No. 177 Session of 2000


        INTRODUCED BY MELLOW, JUBELIRER AND RHOADES, MAY 16, 2000

        INTRODUCED AND ADOPTED, MAY 16, 2000

                                  A RESOLUTION

     1  Urging district committees of the Pennsylvania Interscholastic
     2     Athletic Association to reject any proposal to reimburse the
     3     PIAA for certain legal expenses, including a judgment.

     4     WHEREAS, The Pennsylvania Interscholastic Athletic
     5  Association is a nonprofit organization charged with
     6  administering high school athletics within this Commonwealth;
     7  and
     8     WHEREAS, The Pennsylvania Interscholastic Athletic
     9  Association is divided into 11 geographic districts for purposes
    10  of administering interscholastic athletics at the local level;
    11  and
    12     WHEREAS, The 11 districts comprising the Pennsylvania
    13  Interscholastic Athletic Association are governed by district
    14  committees that are composed of school district officials from
    15  that respective region; and
    16     WHEREAS, The Pennsylvania Interscholastic Athletic
    17  Association district committee revenues and funds primarily are
    18  accumulated through Pennsylvania taxpayers who support the

     1  student-athletes and school districts of this Commonwealth; and
     2     WHEREAS, The Pennsylvania Interscholastic Athletic
     3  Association recently has been found by a court of law to have
     4  discriminated against a female official on the basis of her sex
     5  and, as a result of this finding, the Pennsylvania
     6  Interscholastic Athletic Association is required to pay the
     7  female official monetary damages; and
     8     WHEREAS, The total cost to the Pennsylvania Interscholastic
     9  Athletic Association relating to this lawsuit is over $920,000;
    10  and
    11     WHEREAS, The Pennsylvania Interscholastic Athletic
    12  Association intends to require each district committee to
    13  proportionally reimburse the Pennsylvania Interscholastic
    14  Athletic Association for the costs associated with the lawsuit
    15  in the following amounts:
    16         District 1 - $39,789
    17         District 2 - $23,684
    18         District 3 - $57,789
    19         District 4 - $21,316
    20         District 5 - $9,474
    21         District 6 - $24,631
    22         District 7 - $64,422
    23         District 8 - $5,211
    24         District 9 - $15,158
    25         District 10 - $27,947
    26         District 11 - $25,579;
    27  and
    28     WHEREAS, The district committees should not be financially
    29  penalized for the irresponsible actions of the Pennsylvania
    30  Interscholastic Athletic Association Board of Control in their

     1  decision to defend the lawsuit; therefore be it
     2     RESOLVED, That the Senate strongly urge the various district
     3  committees of the Pennsylvania Interscholastic Athletic
     4  Association to vote against any proposal that would require the
     5  district committees to proportionally reimburse the Pennsylvania
     6  Interscholastic Athletic Association for the judgment levied
     7  against, and the costs incurred by, the Pennsylvania
     8  Interscholastic Athletic Association in defending this lawsuit;
     9  and be it further
    10     RESOLVED, That the Senate strongly urge the various district
    11  committees of the Pennsylvania Interscholastic Athletic
    12  Association to refuse to comply with any directive of the
    13  Pennsylvania Interscholastic Athletic Association Board of
    14  Control that requires the district committees to proportionally
    15  reimburse the Pennsylvania Interscholastic Athletic Association
    16  for the judgment levied against, and the costs incurred by, the
    17  Pennsylvania Interscholastic Athletic Association in defending
    18  this lawsuit.
