AN ACT
1Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2Consolidated Statutes, in offenses against the family,
3further providing for the offense of endangering welfare of
4children.
5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:
7Section 1. Section 4304(b) of Title 18 of the Pennsylvania
8Consolidated Statutes is amended to read:
9§ 4304. Endangering welfare of children.

11(b) Grading.--[An]
12(1) Except as provided under paragraphs (2) and (3), an
13offense under this section constitutes a misdemeanor of the
14first degree. [However, where]
15(2) If there is a course of conduct of endangering the
16welfare of a child, the offense constitutes a felony of the
17third degree.
18(3) If an offense under this section is the result of
1leaving a child under 13 years of age in a motor vehicle
2without adult supervision, the offense constitutes a felony
3of the third degree.
4Section 2. This act shall take effect in 60 days.
