AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

2

Pennsylvania Consolidated Statutes, in budget and finance,

3

further providing for Commonwealth portion of fines.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 3571(b)(2) of Title 42 of the

7

Pennsylvania Consolidated Statutes is amended and the subsection

8

is amended by adding a paragraph to read:

§ 3571.  Commonwealth portion of fines, etc.

(b)  Vehicle offenses.--

(2)  (i)  Except as provided in [paragraph (4)] 

14

paragraphs (4) and (5), when prosecution under any other

15

provision of Title 75 (relating to vehicles) is the

16

result of State Police action, all fines, forfeited

17

recognizances and other forfeitures imposed, lost or

18

forfeited shall be payable to the Commonwealth, for

credit to the Motor License Fund. One-half of the revenue

2

shall be paid to municipalities as designated in

3

subparagraph (ii) in the same ratio provided in section 4

4

of the act of June 1, 1956 (1955 P.L.1944, No.655),

5

[relating to partial allocation of liquid fuels and fuel

6

use tax proceeds.] referred to as the Liquid Fuels Tax

7

Municipal Allocation Law.

(ii)  (A)  Only municipalities that provide at least

9

40 hours per week of local police services through a

10

municipal police department, participation in a

11

regional police department or contracts with other

12

municipal or regional police for police services may

13

receive revenue under subparagraph (i).

14

(B)  Revenue that is not paid to municipalities

15

under clause (A) shall be transferred to the

16

Pennsylvania State Police for cadet classes.

(5)  When prosecution under any other provision of Title

19

75 is the result of State Police action on an interstate

20

highway, as defined in 75 Pa.C.S. § 102 (relating to

21

definitions), all fines, forfeited recognizances and other

22

forfeitures imposed, lost or forfeited shall be payable to

23

the Commonwealth, for credit to the Motor License Fund.

Section 2.  This act shall take effect in 60 days.
