| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, providing for the offense of |
3 | aggravated assault by a person in custody. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 18 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 2703.2. Aggravated assault by a person in custody. |
9 | A person who is in the custody of the police or other law |
10 | enforcement agency commits a felony of the third degree if he, |
11 | while in custody, intentionally or knowingly causes or attempts |
12 | to cause another to come into contact with blood, seminal fluid, |
13 | saliva, urine or feces by throwing, tossing, spitting or |
14 | expelling such fluid or material. |
15 | Section 2. This act shall take effect in 60 days. |
