AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for reports by police. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Section 3751 of Title 75 of the Pennsylvania 6 Consolidated Statutes is amended to read: 7 § 3751. Reports by police. 8 (a) General rule.--Every police department that investigates 9 a vehicle accident for which a report must be made as required 10 in this subchapter and prepares a written report as a result of 11 an investigation either at the time and at the scene of the 12 accident or thereafter by interviewing the participants or 13 witnesses shall, within 15 days of the accident, forward an 14 initial written report of the accident to the department. If the 15 initial report is not complete, a supplemental report shall be 16 submitted at a later date. 17 (b) Furnishing copies of report.--Police departments shall,
1 upon request, furnish at a cost not to exceed $15 a certified 2 copy of the full report of the police investigation of any 3 vehicle accident to any person involved in the accident, his 4 attorney or insurer, and to the Federal Government, branches of 5 the military service, Commonwealth agencies, and to officials of 6 political subdivisions and to agencies of other states and 7 nations and their political subdivisions. No fee shall be 8 charged by the Pennsylvania State Police for requests by public 9 agencies of the Commonwealth, including members of the General 10 Assembly, or by political subdivisions thereof when the requests 11 are made for public purposes. The copy of the report shall not 12 be admissible as evidence in any action for damages or criminal 13 proceedings arising out of a motor vehicle accident. Police 14 departments may refuse to furnish the complete copy of 15 investigation of the vehicle accident whenever there are 16 criminal charges pending against any persons involved in the 17 vehicle accident unless the Pennsylvania Rules of Criminal 18 Procedure require the production of the documents. 19 Section 2.
