                                     AN ACT

     1  Amending the act of December 19, 1984 (P.L.1093, No.219),
     2     entitled "An act relating to noncoal surface mining
     3     conservation and reclamation," further providing for mining
     4     permits.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 7 of the act of December 19, 1984
     8  (P.L.1093, No.219), known as the Noncoal Surface Mining
     9  Conservation and Reclamation Act, is amended by adding a
    10  subsection to read:
    11  Section 7.  Mining permit; reclamation plan.

    13     (b.1)  Engineering and traffic study.--
    14         (1)  As part of each application for a permit, the
    15     operator shall commission a traffic and engineering study
    16     concerning the tract or tracts of land to be affected by the
    17     operation. The operator shall submit the traffic and
    18     engineering study to the Department of Transportation, which


     1     shall review the traffic and engineering study and advise the
     2     Department of Environmental Protection on matters involving
     3     infrastructure and safety. The Department of Environmental
     4     Protection may require, as a permit condition, that the
     5     operator address such infrastructure and safety issues as the
     6     department deems necessary.
     7         (2)  As used in this section, the term "engineering and
     8     traffic study" means an orderly examination or analysis of
     9     physical features and traffic conditions conducted in
    10     accordance with regulations of the Department of
    11     Transportation and conforming to generally accepted
    12     engineering standards and practices for the purpose of
    13     ascertaining the need or lack of need for a particular action
    14     by the department or a local government.

    16     Section 2.  This act shall take effect in 60 days.
