| A RESOLUTION |
| |
1 | Urging the Congress of the United States to enact H.R. 4542, the |
2 | "Stopping Criminal Trials for Guantanamo Terrorists Act of |
3 | 2010." |
4 | WHEREAS, On November 13, 2009, the United States Department |
5 | of Justice announced that the admitted September 11, 2001, |
6 | terror attacks mastermind Khalid Sheikh Mohammed and his four |
7 | alleged accomplices would be tried in a Federal civilian court |
8 | in Manhattan, considering New York the jurisdiction for the |
9 | crimes; and |
10 | WHEREAS, The Department of Justice's policy asserts the |
11 | primacy of the United States criminal justice system in |
12 | responding to terrorist acts and would not treat suspects as |
13 | unlawful enemy combatants subject to extra-judicial or military |
14 | detention; and |
15 | WHEREAS, Because of increasing opposition, including the |
16 | mayor and police commissioner of New York City, to the decision |
17 | to bring the September 11 suspects to trial in civilian court in |
18 | New York City, just blocks from Ground Zero, the Department of |

1 | Justice is now searching for alternate civilian court trial |
2 | sites; and |
3 | WHEREAS, A bipartisan group of United States Senators has |
4 | asked the United States Attorney General to reconsider his |
5 | position on the trial venue, stating that the "United States |
6 | criminal justice system should not be used for trying enemy |
7 | combatants," and that "given the risks and costs, it is far more |
8 | logical, cost effective and strategically wise to try Khalid |
9 | Sheikh Mohammed and his accomplices in the military commissions |
10 | that Congress has established for that very purpose"; and |
11 | WHEREAS, With the tragic events that occurred on Flight 93 in |
12 | Shanksville, Pennsylvania, jurisdiction could be established to |
13 | prosecute these terrorists in the courts of the Commonwealth of |
14 | Pennsylvania; and |
15 | WHEREAS, The Commonwealth of Pennsylvania should not play |
16 | another unfortunate role related to the September 11, 2001, |
17 | attacks, that of being the location for the civilian trials of |
18 | the terrorists; and |
19 | WHEREAS, Pennsylvanians strongly insist that these terrorists |
20 | be brought to justice, but the security threats and financial |
21 | burdens are too great for the taxpayers of the Commonwealth of |
22 | Pennsylvania; and |
23 | WHEREAS, H.R. 4542, introduced by New York Representative |
24 | King, prohibits the Department of Justice from spending any |
25 | funds to prosecute an individual who was detained at Naval |
26 | Station, Guantanamo Bay, Cuba, on or after January 22, 2009, in |
27 | a criminal court located in the United States or in any |
28 | territory or possession of the United States; therefore be it |
29 | RESOLVED, That the Senate of the Commonwealth of Pennsylvania |
30 | urge the Congress of the United States to enact H.R. 4542, the |

2 | 2010"; and be it further |
3 | RESOLVED, That a copy of this resolution be transmitted to |
4 | the President of the United States, the Attorney General of the |
5 | United States, the presiding members of each house of Congress |
6 | and each member of Congress from Pennsylvania. |
