AN ACT

 

1Amending the act of June 28, 1995 (P.L.89, No.18), entitled "An
2act creating the Department of Conservation and Natural
3Resources consisting of certain functions of the Department
4of Environmental Resources and the Department of Community
5Affairs; renaming the Department of Environmental Resources
6as the Department of Environmental Protection; defining the
7role of the Environmental Quality Board in the Department of
8Environmental Protection; making changes to responsibilities
9of the State Conservation Commission and the Department of
10Agriculture; transferring certain powers and duties to the
11Department of Health; and repealing inconsistent acts," in
12Department of Conservation and Natural Resources, further
13providing for rivers conservation; and establishing the Water
14Recreation Advisory Board.

15The General Assembly of the Commonwealth of Pennsylvania
16hereby enacts as follows:

17Section 1.  Section 307 heading of the act of June 28, 1995 
18(P.L.89, No.18), known as the Conservation and Natural Resources
19Act, is amended and the section is amended by adding a
20subsection to read:

21Section 307.  [Rivers conservation] Water resources and 
22recreation.

24(c)  Inventory of recreational opportunities.--

1(1)  The department shall inventory all rivers, streams
2and lakes in this Commonwealth to identify current boating,
3canoeing, rafting and other recreational activities,
4including water levels and related water conditions, for the
5purpose of making the information available to the public in
6published form.

7(2)  The inventory shall include, but not be limited to,
8recreational activities offered by:

9(i)  the department;

10(ii)  the Pennsylvania Fish and Boat Commission;

11(iii)  the Pennsylvania Game Commission;

12(iv)  the National Park Service;

13(v)  the United States Army Corps of Engineers;

14(vi)  the United States Soil Conservation Service;

15(vii)  the Federal Energy Regulatory Commission;

16(viii)  the United States Forest Service; and

17(ix)  other public and private entities.

18(3)  The Water Recreation Advisory Board shall assist the
19department in compiling the inventory. The first inventory
20shall be completed by January 1, 2014, and shall be updated
21every two years.

22Section 2.  The act is amended by adding a section to read:

23Section 315.1.  Water Recreation Advisory Board.

24(a)  Establishment.--There is hereby established the Water
25Recreation Advisory Board to assist the department in
26identifying water resources for recreational activities and in
27compiling the inventory required by section 307(c).

28(b)  Members.--The board shall be composed of representatives
29of environmental and recreational organizations, especially
30interested in water resources and water recreational activities.

1The members of the board shall be appointed by the secretary and
2shall represent the various geographical regions of this
3Commonwealth. The secretary shall designate a member of the
4board as presiding officer. The board shall meet at least
5annually.

6(c)  Expenses of members.--The members of the board shall
7receive no compensation for their services but shall be
8reimbursed for their actual and necessary expenses incurred in
9carrying out their duties as members of the board.

10(d)  Other duties.--In addition to assisting the department
11in identifying water resources for recreational activities and
12in compiling the inventory required by section 307(c), the board
13shall have such other duties as may be determined by the
14secretary.

15Section 3.  This act shall take effect in 60 days.
