AN ACT

 

1Providing for the prevention, detection, treatment and follow-up
2of cases of hepatitis B among State and local law enforcement
3officers, firefighters, paramedics, emergency medical
4technicians, ambulance attendants, first responders and
5health professionals.

6The General Assembly of the Commonwealth of Pennsylvania
7hereby enacts as follows:

8Section 1.  Short title.

9This act shall be known and may be cited as the Emergency and
10Law Enforcement Officer Hepatitis B Inoculation Act.

11Section 2.  Statewide program.

12In accordance with adopted standards consistent with accepted
13public health practice and the recommendations of the Centers
14for Disease Control and Prevention, the Department of Health
15shall establish a Statewide program for the prevention,
16including inoculations, screening, diagnosis, treatment and
17medical and environmental follow-up of cases, of hepatitis B for
18State and local law enforcement officers, firefighters,
19paramedics, emergency medical technicians, ambulance attendants,
20first responders and health professionals. The Statewide program

1shall include procedures whereby those receiving inoculations
2under this act shall apply for Federal funds available to offset
3all or part of the costs of the inoculations. The Department of
4Health shall make public a summary of the Statewide program.

5Section 3.  Eligible persons.

6Every State and local law enforcement officer, firefighter,
7paramedic, emergency medical technician, ambulance attendant,
8first responder and health professional within this Commonwealth
9who is determined to be at risk for hepatitis B according to
10standards for the Statewide program adopted by the Department of
11Health shall be eligible for services under this act.

12Section 4.  Powers and duties of Department of Health.

13The Department of Health shall provide financial support to
14State, district, county or local governmental or private
15agencies which agree to provide screening, diagnostic,
16treatment, educational and follow-up services as required under
17the standards established for the Statewide program for the
18establishment of local hepatitis B detection, treatment or
19prevention projects.

20Section 5.  Annual report.

21The Department of Health shall publish an annual report which
22shall include, at a minimum, the number of State and local law
23enforcement officers, firefighters, paramedics, emergency
24medical technicians, ambulance attendants, first responders and
25health professionals found to have hepatitis B.

26Section 6.  Immunity.

27No person shall be liable for civil damages as a result of an
28act, or the omission of an act, committed while rendering
29services in good faith and in accordance with the provisions of
30this act.

1Section 7.  Effective date.

2This act shall take effect immediately.
