AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," establishing the Commission 21 on Health Care for the Aging within the Department of Aging; 22 and providing for the powers and duties of the commission. 23 The General Assembly of the Commonwealth of Pennsylvania 24 hereby enacts as follows: 25 Section 1. The act of April 9, 1929 (P.L.177, No.175), known 26 as The Administrative Code of 1929, is amended by adding a 27 section to read:
1 Section 2214-A. Commission on Health Care for the Aging.-- 2 (a) The Commission on Health Care for the Aging is established 3 within the Department of Aging which shall consist of eleven 4 persons at least six of whom shall be sixty years of age or 5 older. Six members of the commission shall constitute a quorum 6 for the conduct of matters which come before it. Absence of a 7 member at three consecutive meetings shall result in the member 8 forfeiting the seat, unless the member requests in writing and 9 receives approval from the presiding officer for an absence 10 necessitated by illness of the member or the death of a family 11 member. 12 (b) The members of the commission shall be nominated by the 13 Governor, subject to the consent of a majority of the members 14 elected to the Senate, and shall represent, as far as possible, 15 different geographical sections of this Commonwealth. In 16 addition, the commission shall include representatives of the 17 long-term care industry. The members shall serve staggered 18 three-year terms and shall serve until their successors are 19 appointed and qualified. Members shall be eligible for 20 reappointment. 21 (c) The commission shall provide for its organization and 22 procedure including the selection of a presiding officer and 23 such other officers as deemed necessary. 24 (d) The commission shall have the following powers and 25 duties: 26 (1) To conduct a general study of the long-term care 27 industry and the inclusion of Medicare-eligible persons under 28 broad health care reform initiatives. 29 (2) To make recommendations concerning the advisability of 30 including long-term care as a component of overall health care 20030S0270B0272 - 2 -
1 reform by the Commonwealth and including Medicare-eligible 2 persons under overall health care reform. 3 (3) To develop a definition of long-term care. 4 (4) To establish the components of the continuum of care. 5 (5) To make recommendations to the General Assembly 6 regarding long-term care legislation and the inclusion of 7 Medicare-eligible persons under overall health care reform. 8 Section 2.
