AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," providing for school breakfast and 6 lunch programs, for nutrition education and for technical 7 support services. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. The act of March 10, 1949 (P.L.30, No.14), known 11 as the Public School Code of 1949, is amended by adding sections 12 to read: 13 Section 1337.1. School Breakfast Program.--(a) Each school 14 district in this Commonwealth is encouraged to make the benefits 15 of the National School Breakfast Program provided by the Child 16 Nutrition Act of 1966 (Public Law 89-642, 42 U.S.C. § 1771 et 17 seq.) available to all students at all grade levels. 18 (b) Beginning with the 1999-2000 school year, each school 19 food authority which participates in the National School Lunch 20 Program shall receive a financial incentive from the
1 Commonwealth to start or expand the daily participation rate of 2 its students in the National School Breakfast Program. 3 (c) Financial incentives shall be made from funds annually 4 appropriated by the General Assembly to the Department of 5 Education for school food services. 6 (d) Financial incentives for the 1999-2000 school year shall 7 be in the following amounts: 8 (1) Each school building which offers lunch and breakfast 9 programs with daily student participation rates in the breakfast 10 program of less than twenty per centum (20%) of enrollment shall 11 receive reimbursements of eight cents (8¢) per lunch served and 12 ten cents (10¢) per breakfast served. 13 (2) Each school building which offers lunch and breakfast 14 programs with daily student participation rates in the breakfast 15 program of twenty per centum (20%) or more of enrollment shall 16 receive reimbursements of ten cents (10¢) per lunch served and 17 ten cents (10¢) per breakfast served. 18 (3) Each school building which offers only the lunch program 19 shall receive a reimbursement of six cents (6¢) per lunch 20 served. 21 (e) For the 2000-2001 school year, and each school year 22 thereafter, financial incentives shall be established by 23 regulation by the Department of Education, except that the 24 financial incentives shall be no less than the amounts 25 established in this section for the 1999-2000 school year. 26 (f) Financial incentives shall be paid to a school food 27 authority during the school year in which they are earned based 28 on reports submitted to the Department of Education. 29 Section 1377.2. Nutrition Education.--Each school district 30 in this Commonwealth is encouraged to provide nutrition 19990S0345B0353 - 2 -
1 education to all students at all grade levels. 2 Section 1377.3. Technical Support Services to Expand 3 Nutrition Opportunities.--(a) The Department of Education shall 4 provide technical support services to assist school food 5 authorities in developing and expanding school breakfast 6 programs. These support services shall include, but not be 7 limited to, compilation of successful approaches to overcoming 8 barriers to program development. 9 (b) The Department of Education shall provide technical 10 support services to assist school districts in developing or 11 enhancing nutrition education programs. These support services 12 shall include, but not be limited to, assistance in seeking 13 grant funds. 14 Section 2. This act shall take effect immediately. A20L24BIL/19990S0345B0353 - 3 -
