AN ACT 1 Amending Title 42 (Judiciary and Judicial Procedure) of the 2 Pennsylvania Consolidated Statutes, further providing for 3 costs in criminal cases; and creating the Crime Containment 4 Officer Fund. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 1725.1(f) of Title 42 of the Pennsylvania 8 Consolidated Statutes is amended and the section is amended by 9 adding subsections to read: 10 § 1725.1. Costs. 11 * * * 12 (b.1) Crime containment officer charge.-- 13 (1) In addition to the costs imposed under subsection 14 (b) and by general rule, the minor judiciary or the court of 15 common pleas shall impose in every criminal case a charge of 16 $25 where a conviction, guilty plea or a plea of nolo 17 contendere is recorded and a charge of $1 in all summary 18 cases where there is a plea of guilty or a finding of guilty
1 by the court. 2 (2) Notwithstanding any other provision of law, the 3 charge imposed under this subsection shall be deposited into 4 the Crime Containment Officer Fund provided that there has 5 been payment of full restitution to the victim in the 6 criminal case or summary case. 7 (b.2) There is hereby created in the State Treasury the 8 Crime Containment Officer Fund as a special, nonlapsing fund. 9 Moneys in the Crime Containment Officer Fund shall be expended 10 for the purposes set forth in 53 Pa.C.S. § 2172 (relating to 11 Crime Containment Officer Program). 12 * * * 13 (f) Annual increase in costs.--Beginning on January 1, 1994, 14 and each January 1 thereafter, the costs and charges under 15 subsections (a), (b), (b.1) and (c) shall be increased by the 16 percentage of increase in the Consumer Price Index for Urban 17 Workers for the immediate preceding calendar year which shall be 18 published in the Pennsylvania Bulletin annually by the Supreme 19 Court on or before the preceding November 30.
