A SUPPLEMENT 1 To the act of May 7, 1998 (P.L.343, No.52), entitled "An act 2 providing for the capital budget for the fiscal year 1998- 3 1999," itemizing public improvement projects, furniture and 4 equipment projects, transportation assistance projects, 5 redevelopment assistance and redevelopment assistance capital 6 projects, flood control projects, Keystone Recreation, Park 7 and Conservation projects, forestry bridge projects and drug 8 forfeiture fund projects to be constructed or acquired or 9 assisted by the Department of General Services, the 10 Department of Conservation and Natural Resources, the 11 Department of Environmental Protection, the Department of 12 Community and Economic Development, the Department of 13 Transportation, the Pennsylvania Fish and Boat Commission or 14 the Pennsylvania Game Commission, together with their 15 estimated financial costs; authorizing the incurring of debt 16 without the approval of the electors for the purpose of 17 financing the projects to be constructed or acquired or 18 assisted by the Department of General Services, the 19 Department of Conservation and Natural Resources, the 20 Department of Environmental Protection, the Department of 21 Community and Economic Development or the Department of 22 Transportation; stating the estimated useful life of the 23 projects; authorizing certain waivers; making appropriations; 24 and making repeals. 25 The General Assembly of the Commonwealth of Pennsylvania 26 hereby enacts as follows: 27 Section 1. Short title. 28 This act shall be known and may be cited as the Capital 29 Budget Project Itemization Act for 1998-1999.
1 Section 2. Total authorizations. 2 (a) Public improvements.--The total authorization for the 3 additional capital projects in the category of public 4 improvement projects itemized in section 3 and to be acquired or 5 constructed by the Department of General Services, its 6 successors or assigns, and to be financed by the incurring of 7 debt, shall be $1,152,466,000. 8 (b) Furniture and equipment.--The total authorization for 9 the additional capital projects in the category of public 10 improvement projects consisting of the acquisition of original 11 movable furniture and equipment to complete public improvement 12 projects itemized in section 4 and to be acquired by the 13 Department of General Services, its successors or assigns, and 14 to be financed by the incurring of debt, shall be $74,517,000. 15 (c) Transportation assistance.--The total authorization for 16 the capital projects in the category of transportation 17 assistance projects itemized in section 5 with respect to which 18 an interest is to be acquired in or constructed by the 19 Department of Transportation, its successors or assigns, and to 20 be financed by the incurring of debt, shall be $641,224,000. 21 (d) Redevelopment assistance.--The total authorization for 22 the additional capital projects in the category of redevelopment 23 assistance and redevelopment assistance capital projects 24 itemized in section 6 for capital grants by the Department of 25 Community and Economic Development, its successors or assigns, 26 and to be financed by the incurring of debt, shall be 27 $1,934,500,000. 28 (e) Flood control.--The total authorization for the capital 29 projects in the category of flood control projects itemized in 30 section 7 and to be constructed by the Department of 19990S0572B0593 - 2 -
1 Environmental Protection, its successors or assigns, and to be 2 financed by the incurring of debt, shall be $44,458,000. 3 (f) Keystone Recreation, Park and Conservation.--The total 4 authorization for the capital projects in the category of 5 Keystone Recreation, Park and Conservation projects itemized in 6 section 8 and to be constructed by the Department of 7 Conservation and Natural Resources, its successors or assigns, 8 and to be financed from revenues in the Keystone Recreation, 9 Park and Conservation Fund shall be $89,455,000. 10 (g) Game Fund projects.--The total authorization for the 11 capital projects in the category of public improvement projects 12 itemized in section 9 to be acquired by the Pennsylvania Game 13 Commission and to be financed from current revenues of the Game 14 Fund pursuant to executive authorizations shall be $1,927,000. 15 (h) Fish and Boat Fund projects.--The total authorization 16 for the capital projects in the category of public improvement 17 projects itemized in section 10 to be acquired or developed by 18 the Pennsylvania Fish and Boat Commission and to be financed 19 from current revenues of the Boat Fund and the Fish Fund 20 pursuant to executive authorization shall be $2,238,000. 21 (i) State Forestry Bridge projects.--The total authorization 22 for the capital projects in the category of State forestry 23 bridge projects itemized in section 11 to be constructed by the 24 Department of Conservation and Natural Resources, its successors 25 or assigns, and to be financed by oil company franchise tax 26 revenues pursuant to 75 Pa.C.S. § 9502(a)(2)(iv) (relating to 27 imposition of tax), shall be $31,228,000. 28 (j) Drug Forfeiture Funds projects.--The total authorization 29 for the capital project in the category of public improvement 30 projects itemized in section 12 to be acquired or developed by 19990S0572B0593 - 3 -
1 the Department of General Services for the Pennsylvania State 2 Police, its successors or assigns, and to be financed by drug 3 forfeiture revenues shall be $300,000. 4 Section 3. 1 (a) Waivers for current itemizations.--The limitation on 2 Department of Transportation funding of capital projects under 3 74 Pa.C.S. § 1302(4) (relating to program authorizations) shall 4 be totally waived for the capital projects in the category of 5 transportation assistance projects for mass transit contained in 6 section 5(a)(10)(iii), (iv), (xi), (xii), (xiii), (xiv) and (xv) 7 and (12)(xii), (xiii) and (xiv). 8 (b) Limited waiver of local requirement for 1997 9 itemization.--Notwithstanding any provision to the contrary, the 10 limitation on Department of Transportation funding of capital 11 projects under 74 Pa.C.S. § 1302(4) (relating to program 12 authorizations) shall be totally waived for the capital projects 13 in the category of transportation assistance projects for mass 14 transit contained in section 5(a)(16)(xxxi) and (xxxii) of the 15 Act of October 10, 1997 (P.L.392, No.47), known as the Capital 16 Budget Project Itemization Act for 1996-1997. 17 Section 14. Debt authorization. 18 (a) Public improvements.--The Governor, Auditor General and 19 State Treasurer are hereby authorized and directed to borrow 20 from time to time in addition to any authorization heretofore or 21 hereafter enacted, on the credit of the Commonwealth, subject to 22 the limitations provided in the current capital budget, money 23 not exceeding in the aggregate the sum of $1,152,466,000 as may 24 be found necessary to carry out the acquisition and construction 25 of the public improvement projects specifically itemized in a 26 capital budget. 27 (b) Furniture and equipment.--The Governor, Auditor General 28 and State Treasurer are hereby authorized and directed to borrow 29 from time to time in addition to any authorization heretofore or 30 hereafter enacted, on the credit of the Commonwealth, subject to 19990S0572B0593 - 136 -
1 the limitations provided in the current capital budget, money 2 not exceeding in the aggregate the sum of $74,517,000 as may be 3 found necessary to carry out the public improvement projects 4 consisting of the acquisition of original movable furniture and 5 equipment specifically itemized in a capital budget. 6 (c) Transportation assistance.--The Governor, Auditor 7 General and State Treasurer are hereby authorized and directed 8 to borrow from time to time in addition to any authorization 9 heretofore or hereafter enacted, on the credit of the 10 Commonwealth, subject to the limitations provided in the current 11 capital budget, money not exceeding in the aggregate the sum of 12 $641,224,000 as may be found necessary to carry out the 13 acquisition and construction of the transportation assistance 14 projects specifically itemized in a capital budget. 15 (d) Redevelopment assistance.--Subject to the limitation in 16 section 317(b) of the act of February 1, 1999 (P.L. , No.1), 17 known as the Capital Facilities Debt Enabling Act, the Governor, 18 Auditor General and State Treasurer are hereby authorized and 19 directed to borrow from time to time in addition to any 20 authorization heretofore or hereafter enacted, on the credit of 21 the Commonwealth, subject to the limitations provided in the 22 current capital budget, money not exceeding in the aggregate the 23 sum of $1,934,500,000 as may be found necessary to carry out the 24 redevelopment assistance and the redevelopment capital 25 assistance projects specifically itemized in a capital budget. 26 (e) Flood control.--The Governor, Auditor General and State 27 Treasurer are hereby authorized and directed to borrow from time 28 to time in addition to any authorization heretofore or hereafter 29 enacted, on the credit of the Commonwealth, subject to the 30 limitations provided in the current capital budget, money not 19990S0572B0593 - 137 -
1 exceeding in the aggregate the sum of $44,458,000 as may be 2 found necessary to carry out the acquisition and construction of 3 the flood control projects specifically itemized in a capital 4 budget. 5 Section 15. Issue of bonds. 6 The indebtedness authorized in this act shall be incurred, 7 from time to time, and shall be evidenced by one or more series 8 of general obligation bonds of the Commonwealth in such 9 aggregate principal amount for each series as the Governor, the 10 Auditor General and the State Treasurer shall determine, but the 11 latest stated maturity date shall not exceed the estimated 12 useful life of the projects being financed as stated in section 13 16. 14 Section 16. Estimated useful life and term of debt. 15 (a) Estimated useful life.--The General Assembly states that 16 the estimated useful life of the public improvement projects 17 itemized in this act is as follows: 18 (1) Public improvement projects, 30 years. 19 (2) Furniture and equipment projects, 10 years. 20 (3) Transportation assistance projects: 21 (i) Rolling stock, 15 years. 22 (ii) Passenger buses, 12 years. 23 (iii) Furniture and equipment, 10 years. 24 (iv) All others, 30 years. 25 (b) Term of debt.--The maximum term of the debt authorized 26 to be incurred under this act is 30 years. 27 Section 17. Appropriations. 28 (a) Public improvements.--The net proceeds of the sale of 29 the obligations authorized in this act are hereby appropriated 30 from the Capital Facilities Fund to the Department of General 19990S0572B0593 - 138 -
1 Services in the maximum amount of $1,152,466,000 to be used by 2 it exclusively to defray the financial cost of the public 3 improvement projects specifically itemized in a capital budget. 4 After reserving or paying the expenses of the sale of the 5 obligation, the State Treasurer shall pay to the Department of 6 General Services the moneys as required and certified by it to 7 be legally due and payable. 8 (b) Furniture and equipment.--The net proceeds of the sale 9 of the obligations authorized in this act are hereby 10 appropriated from the Capital Facilities Fund to the Department 11 of General Services in the maximum amount of $74,517,000 to be 12 used by it exclusively to defray the financial cost of the 13 public improvement projects consisting of the acquisition of 14 original movable furniture and equipment specifically itemized 15 in a capital budget. After reserving or paying the expenses of 16 the sale of the obligation, the State Treasurer shall pay to the 17 Department of General Services the moneys as required and 18 certified by it to be legally due and payable. 19 (c) Transportation assistance.--The net proceeds of the sale 20 of the obligations authorized in this act are hereby 21 appropriated from the Capital Facilities Fund to the Department 22 of Transportation in the maximum amount of $641,224,000 to be 23 used by it exclusively to defray the financial cost of the 24 transportation assistance projects specifically itemized in a 25 capital budget. After reserving or paying the expense of the 26 sale of the obligation, the State Treasurer shall pay to the 27 Department of Transportation the moneys as required and 28 certified by it to be legally due and payable. 29 (d) Redevelopment assistance.--The net proceeds of the sale 30 of the obligations authorized in this act are hereby 19990S0572B0593 - 139 -
1 appropriated from the Capital Facilities Fund to the Department 2 of Community and Economic Development in the maximum amount of 3 $1,934,500,000 to be used by it exclusively to defray the 4 financial cost of the redevelopment assistance and redevelopment 5 capital assistance projects specifically itemized in a capital 6 budget. After reserving or paying the expenses of the sale of 7 the obligation, the State Treasurer shall pay to the Department 8 of Community and Economic Development the moneys as required and 9 certified by it to be legally due and payable. 10 (e) Flood control.--The net proceeds of the sale of the 11 obligations authorized in this act are hereby appropriated from 12 the Capital Facilities Fund to the Department of Environmental 13 Protection in the maximum amount of $44,458,000 to be used by it 14 exclusively to defray the financial cost of the flood control 15 projects specifically itemized in a capital budget. After 16 reserving or paying the expense of the sale of the obligation, 17 the State Treasurer shall pay to the Department of Environmental 18 Protection the moneys as required and certified by it to be 19 legally due and payable. 20 Section 18. Federal funds. 21 (a) Projects itemized in this act.--In addition to those 22 funds appropriated in section 17, all moneys received from the 23 Federal Government for the projects specifically itemized in 24 this act are also hereby appropriated for those projects. 25 (b) Projects not requiring itemization.--Department of 26 Military and Veterans Affairs construction projects which are 27 totally federally funded but which are to be administered by the 28 Department of General Services are hereby authorized. 29 (c) Projects to be completed with Federal funds only.-- 30 Federal funds in the amount of $3,548,000 are authorized for the 19990S0572B0593 - 140 -
1 construction of an organization maintenance shop at Johnstown 2 for the Department of Military and Veterans Affairs. Federal 3 funds in the amount of $6,862,000 are authorized for the 4 construction of an organization maintenance shop at Pittsburgh 5 for the Department of Military and Veterans Affairs. 6 Section 19. Expiration of authorization and appropriation. 7 (a) General rule.--The authorization and appropriation for 8 the additional capital projects itemized in sections 3, 4, 5, 6, 9 7, 8, 9, 10, 11 and 12 for which construction contracts have not 10 been executed within four years of the effective date of this 11 act shall expire upon such date and shall be considered 12 repealed. The Secretary of the Budget may extend an expired 13 project for up to one year upon written notification of the 14 majority chairman and minority chairman of the Appropriations 15 Committee of the Senate and the majority chairman and minority 16 chairman of the Appropriations Committee of the House of 17 Representatives. Upon expiration of the extension period, an 18 extended project may not be subsequently extended. 19 (b) Reports.--Whenever the authorization and appropriation 20 for the additional capital projects itemized under this act 21 shall expire pursuant to subsection (a) or whenever the 22 authorization and appropriation for the additional capital 23 projects itemized under the act of October 10, 1997 (P.L.392, 24 No.47), known as the Capital Budget Project Itemization Act of 25 1996-1997, shall expire pursuant to section 20 of said act, the 26 Secretary of the Budget shall, within 30 days of the date of 27 expiration, provide to the majority and minority chairmen of the 28 Appropriations Committee of the Senate and the majority and 29 minority chairmen of the Appropriations Committee of the House 30 of Representatives a report itemizing all capital projects which 19990S0572B0593 - 141 -
1 have expired. Such report shall contain specific references to 2 the section of the act wherein the projects were itemized and 3 shall include the project location, project description and 4 authorized project amount. The report shall also aggregate the 5 total dollar amount of expired projects by capital project 6 category. 7 Section 20. Repeals. 8 The following acts and parts of acts are repealed: 9 (1) Section 3(3)(i)(A) of the act of July 2, 1993 10 (P.L.265, No.47), known as the Capital Budget Project 11 Itemization Act for 1993-1994. 12 (2) Section 5(b)(6)(i)(A) of the act of July 8, 1994 13 (P.L.444, No.74), known as the Capital Budget Project 14 Itemization Act for 1994-1995. 15 (3) Section 6(2)(iii)(F) and (H), (15)(ii)(A), (B) and 16 (C) and (36)(i) of the act of October 10, 1997 (P.L.392, 17 No.47), known as the Capital Budget Project Itemization Act 18 for 1996-1997. 19 Section 21. Editorial changes. 20 In editing and preparing this act for printing following the 21 final enactment, the Legislative Reference Bureau shall insert 22 or revise letters or numbers for projects where the letters or 23 numbers are missing or require revision. The bureau shall also 24 revise the total monetary amounts for the total authorization, 25 debt authorization, appropriations and departmental totals as 26 necessary to agree with the total monetary amounts of the 27 projects. 28 Section 22.
